Can my carrier demand I log unpaid time ( training ) and when I don't, create a logs in the elog system for the training time??
My gut says no....either I do or it don't get done....but my carrier did and says he can.
Lets have it and be sure to back up your opinion.....
Thanks....

First of all paid or not if you're performing work or training for your carrier it must be logged appropriately.
Paper logs have to in your own handwriting but I haven't seen anything prohibiting a carrier from creating electronic logs. -
We were just discussing this on another thread. Realistically they cannot create entries for you. They can not accept your logs based upon their knowledge of events. However recreating the logs seems to be an issue. They can and should discipline you, and ask that you create the entries on your elogs. If you refuse they should create an entry as a remark stating what work you performed during that time, and then the subsequent punishment.
I think things are going to get really interesting in the next few years. There will need to be more guidance specific to elogs, and probably more regulations adapted specifically to logs and procedures regarding logs.
Back on track, no the shouldn't change your logs without your consent. I suggest not certifying any logs that they change without your permission, and then ask for a sit down meeting with the safety director, if he won't listen to your concerns ask for a written policy and take that to a lawyer for review.70s_driver, Lowa3468 and 25(2)+2 Thank this. -
Why are ou refusing to log your training time? We are expected to log on-duty time that is unpaid everyday. PTIs, loading/unloading, fueling, just to name a few. If you've got 24 yrs experience, this should be nothing new to you.
as Meltom said, I don't think they can change your logs. But, they also cannot knowingly allow you to falsify them either. Wht I'm getting at here is that I don't know the answer to your question.70s_driver, NavigatorWife, Lowa3468 and 1 other person Thank this. -
If it's company related it's work ....so it's logged
Lowa3468 and 70s_driver Thank this. -
I agree with the rest, training time is and always has been on duty not driving. Whether they can create a log for you using elog is questionable but if you, yourself don't log it, or refuse to log it, that would be the same thing to D.O.T. as you lying on your logbook. So you might want to consider that also? Lying on your logbook is a jailable offense now, has been for a few years. Not being smart, just pointing out all sides of the issue.
Lowa3468 Thanks this. -
Anything that has to do with your duties at the carrier it must be logged .I don't agree with it unless we get paid for our time but the law is what it is and we must obey it.Or face possible termination and violations.DOnt think you want either. So log every single thing you do.
Lowa3468, 70s_driver and mje Thank this. -
395.2 Guidance
Paper logs entries have to be made by you and no one else. I don't see how EOBRs are any different. But I saved the best for last.
395.8
395.15 EOBRs
After all that then they throw something like this out there.
395.8 Guidance
The bottom line is you are at the direction of the carrier. Therefore On-duty Not Driving. Boss man has the authority to edit your logs as long as he explains why.70s_driver, Meltom and Lowa3468 Thank this. -
You go to an orientation watch videos etc...
That's logged.
Same thing.
Discussion over. -
From the time you start your day till the completion of your day when you are with that carrier it must be logged.Think of your log book as your daily diary only you must keep it current at all times.
mje Thanks this.
