I am the OP. There is mention of the 30-35% ON THE FMCSA WEBSITE. What sucks is what I found using Duck Duck Go (I quit using Google) was a mention that they have NO standard. Yet I was warned in mid April about my BMI by the examiner paid for by my company.

If it's not in the regulations, it's not in the regulations. Just call your state FMCSA people and ask them. It's a very succinct way of getting compliance questions answered w/o all the hullabaloo of "trucker stories." And it may be that a carrier has rules in addition to the FMCSA regs. Can they discriminate based on neck size?

Understand that the FMCSA is backed by the National Chamber of commerce, and they are backed by the people that can't compete with trucks..................drum roll please! ...................THE RAILROADS -

It is what it is. I have had sleep apnea since I was a skinny little kid. When I graduated high school at 5'11 and 132lbs. I figured out a proper thickness pillow stops it. Queen Anne has done a go-around on this issue after Congress ordered her to stop the Sleep Apnea Gestapo program without having gone through the formal rule making required by the Administrative Procedures Act (APA)... so, in response, she pulled the "rule" and issued "guidance" to the newly minted Certified Medical Examiners, many of whom have adopted the position that if the FMCSA issues "guidance," it is a de facto STANDARD which must be observed... I just got my 2-year card from a CME and had the argument with him... I'm 5'8" and 195lbs and the first thing outta his pie hole was: "You need a sleep apnea evaluation" My reply: "NO, I don't!" His answer: "It's the LAW!" My reply: NO it's NOT and if you continue down this road, I'll sue you under Title 42 U.S.C. secs 1985 and 1986, and you'll never practice medicine again" He called FMCSA and put it on speaker so I could hear THEM tell ME I was full of #####... imagine HIS surprise when they backed ME up! LOL! They will not OFFICIALLY declare their policy, they just word it so that it is PERCIEVED by the CME's as a Rule... Being informed is always the BEST way to approach these confrontations.

I guess it depends on where you go. My 2 year card, dated 5/22, didn't seem any different than the last one, question wise.

Turnanburn, It would appear that you have found a CME that KNOWS the rules... if it's not a violation of forum rules, perhaps you could share his/her info so folks can possibly get a run in that direction when they need a new card?
