Illegal for police to look at cell phones.

    This was a sweeping unanimous decision, and a good one. But there will be an exception made for commercial drivers you can bet your last dime on that. They can already search your truck without consent, they can't do that to cars. It will be the same with cell phones.

    Keep in mind that even with a commercial vehicle, a warrant is required for anything that in on the person. If your phone is on you, a warrant is required. Same with anything placed in a pocket.

    Is this also the case for personal effects in the sleeper area? I do not know, but I get the impression after much reading here that the sleeper area is considered a separate and distinct area form the operational area and is subject to certain protections?

    The sleeper area is not part of the commercial motor vehicle and I would state such.

    Failed to mention in my earlier post, that ruling is as it should be. A cell phone is no different than a computer hard drive, diary, file cabinet or the front door of our homes. Nothing wrong with LEOs asking to look at your phone, and they will do that, too many are willing to comply having no clue what their rights are as citizens and LEOs take every advantage of that whenever possible.

    I fear you may be correct that some law enforcement officers will treat smart phones in commercial vehicle differently. If he gives you a ticket for something obtained from the phone, you can try to get the evidence supressed in the court appearance. Keeping it in youy pocket or surrendering any of the phones I dont use regularly will keep Barney Fife at bay.
    I am hoping this discourages the practice completely. Perhaps it is not too late for one branch of government to keep another branch from blantantly taking away our rights.
