Parking Citation - Parking on an on ramp

    One could always claim to be too sick to drive safely. That is federal law . Park in safe area if you can and not drive . An excuse ?Yes, but legitimate. It is the law aside from being common sense.
    Many years ago in a KY rest area I was awakened by a belligerent cop. He said I was at the rest area too long according to him.
    I had planned for this as I knew his reputation..
    I had taken a can of beanie weenies and mushed it up added some water and a bit of soda and poured it out the window. Cop told me I had to leave. I told him too sick to drive, and he was stepping in my vomit. He demanded I leave, so the truck went over the curb in to the landscaping. All said and done I proved I was too sick to safely drive .He was suspended, had to pay for all damage to my truck.He had to pay for the tow bill to get it out of the grass and soft earth.. Ticket was dismissed. Some times it pays to plan ahead. You just have to have the guts to go all the way .

    All said and done parking on a off ramp is very dangerous. If you had been hit in the rear by either another truck or a car you would be held accountable as you were illegally parked.
    People tend to exit at highway speed. Entrance ramps less dangerous but still illegal.

    next time open the hood,set up your triangles,throw on the 4 ways,and snuggle up & sleep away..when they wake you up,you just say your waiting for a service trk..it should be here just about when my ten is up..now good night officer...

    It should ,because in calif its posted,emergency parking only on most ramps,so hood up,..looks like a ER..lol

    That is the whole thing, no parking signs are every where. But, if you leave DALLAS, heading east on I-20, then I-30, everything is full. The rest areas are dinky. Even that rest area on I-35, holy smokes its a circus in there. If you have an over size load I don't know how you can even exit. I went in there a couple weeks back, trucks everywhere. The Flying J before that at that travel stop, the same deal, full to the brim, trucks parked on the street facing both directions. I ended up parking on an ON ramp as well.

    Also, if I can't find a spot at a truck stop, rest area, most places along the interstate don't want trucks parking there, where is a man supposed to park? This is no different than being a homeless man on the street, you can't loiter outside a Wal Mart, you can't sleep on a bench, you can't sleep in a park, you can't panhandle, you can't sit on the side of the road, etc.

    Under the Texas Constitution:

    Sec.A19.AADEPRIVATION OF LIFE, LIBERTY, ETC.; DUE COURSE OF
    LAW. No citizen of this State shall be deprived of life, liberty,
    property, privileges or immunities, or in any manner disfranchised,
    except by the due course of the law of the land

    Cheesy? A stretch? Well, maybe...I'm not asking to park in a fire lane, or park at the fuel island. I'm not bothering anyone on that on ramp. After explaining my case to the officer, he still gave me a ticket. Would he have offered or suggested another place to park? Drivers, you can say I could have trip planned, if I did I would have stopped back on I-35 and missed out on 4 hours of drive time. This on ramp, I was parked about 100 feet away from where people turn on to it. If someone crashed into me, that would be because they came around the turn to fast, or gave too much throttle on slick pavement and fish tailed in to me. I was no where near the end of the ramp where the chance of a rear end collision could occur. This does happen on some ramps, but at this ramp there was a large paved shoulder.

    If there was a place to park, I get it. If they could only give parking citations for people parking on the fuel island...I wasn't parked in front of someones house, or business, or on the shoulder of a highway, interstate. This was last resort. I don't like parking on them either, I think in the past year I've done it maybe 5 times. I stopped at the Loves at 368 in Hillsboro, there were 4 spots left, I parked in one, took my 30 minute break, ate, got fuel and took off, I was about 7 hours in on drive time.

    There does need to be something done about truck parking. Florida is the best state when it comes to rest areas, big, spacious and every 30-60 miles it seems. If it came down to trip planning, we would only be driving 5 hours a day. "Dispatcher, I can't drive any more, no where to park. Sorry."

    I'll write more later, I'll think about it more once I get in contact with the court.

    We had little trouble with parking before the new HOS BS. The ridiculous 30 min break does nothing to help the situation. We are being controlled by ignorant, unknowing politico with nothing behind their ideas and rules than furthering their careers.
    Now we not only have the lack of parking but states, counties and local governments short on funds doing every thing they can to fill their coffers . We are good targets and they assume we don't vote.

    Clerk of Courts works directly with the judge. Your right though, the clerk cannot throw out the ticket or change it but when he talks to the judge and gets permission he can. I've had it done. Changed a speeding ticket to just a fine and no points on my license. The clerks job is to take care of as much business as possible so the judge doesn't. More then half the cases are handled in the hallway by lawyers, one on one and with the clerk of courts.

    I was in my car getting on the highway at home. The on ramp is also the exit ramp. Lots of trucks coming and I floored it to merge in between two trucks instead of them moving over since there was traffic in the second lane. There was cars in back of me and I didn't want to just stop dead on the ramp.

    Instead of taking advise from a bunch of truckers a call to the clerk of courts is simple. I'm sure he/she will give you some other options.

    Well, ended up being $109.00 bucks. Rather than fight it, since its a NON moving violation, I just paid it online. Lesson learned. Simple parking ticket. Some things you just have to let go I guess, even though you want to have the last word.
