I said NO to dispatcher 16hr rule, bad idea?

    I'm not sure if I have a question, or just sharing a story... It felt so good, but I may take a spanking in the end?

    Its a really long story, and I'll fill in the details in a summary at the bottom.
    • Chicago Il, to Dayton Oh = 640 miles round trip.
    • 10:18 avg drive time
    • + :15 min pre-trip
    • + :30 min break
    • + :30 min drop/hook/ other spotting
    • + :12 min safety/drive time buffer
    • ------------------------------------------------------------------
    • =11:45 minus the 14hr leaves me 2hr 15mins for live load.

    I've been burned by this facility before on loading times, and pre-emptively said to my dispatcher I will not take a 16hr exception for these knuckle heads. In fact this was a special request by my dispatcher that I take the load/ otherwise they know to give me a local run.(normaly we have muti loads, today was only mine)
    I informed the "knucle head" of my dead line (2:15hrs) upon arrival and sat patiently for 2hrs. At 15mins till I told them I'm hooking to this trailer and seal it, or I'm grabbing an empty from the yard. He responded my email said 8am BLAH BLAH BLAH...
    I was not about to confront him in argument, and said "wonderful, I'm going to get an empty" I wish I could have seen his face when the door closed! Because, what ensued was a mess of phone calls trying to get me back. The trailer was magicaly sealed and papers printed 2mins after I left the yard. Even more desperate calls said you have a 16hr option, take it now or your off this account.
    I may not be happy with the pay of miles on another account, but this felt so dang good!!!

    it's been discussed on here before, but there IS NO 16 hour exception. i beleive it was even quoted by the only dot officer posting on here occasionally.

    Thereis an exception but it only applies to get to a safe and in severe weather like a blizzard

    Local drivers get a 16hr day once a week.
    I don't recall the exact criteria, but something close to cannot be used again if used in the last 7 days, or last reset. Also must start and end your day at the same location. There may be a couple more criteria I'm not remembering.

    (o) Property-carrying driver. A property-carrying driver is exempt from the requirements of § 395.3(a)(2) if:
    (1) The driver has returned to the driver's normal work reporting location and the carrier released the driver from duty at that location for the previous five duty tours the driver has worked;
    (2) The driver has returned to the normal work reporting location and the carrier releases the driver from duty within 16 hours after coming on duty following 10 consecutive hours off duty; and
    (3) The driver has not taken this exemption within the previous 6 consecutive days, except when the driver has begun a new 7- or 8-consecutive day period with the beginning of any off-duty period of 34 or more consecutive hours as allowed by § 395.3(c).

    Never heard of a 16 hr anything, but then I'm OTR. Kinda sounds like that split sleeper B.S. though - it's there to benefit your company or shipper/receiver...

    16 hour is only for local drivers who always start and stop at same location, or at least for the five previous days, and can only be used once a week. Whether dispatchers or even ALL dot officers understand it is another story though.

    I may be wrong, but I don't think Chicago-Dayton-Chicago would count as local. Even if returning to same terminal every night. Maybe it does, but I bet you'd lose an arguement with the D.O.T. officer on that and need to go see a judge for clarification.
