| Sleeper berth If you go into the sleeper and log it in the sleeper, does it still count against your 14 hour? For instance... 8 hrs driving 2 hours Sleeper (got tired, took a nap) 3 hours driving 3 hours unloading? Or does this put you 2 hours over on your 14? I don't want to split break. After my 14 is up just go into the bunk for 10 Thanks |

| Yep, you're done unless you "slept" for your two hours whilst you were being unloaded. Oh, wait a minute, that's split-breaking, isn't it? Why don't ya want to spli break? It's great for situations just like you've described, 'cept you maybe should have driven only six hours or so before you took your 8 hrs in the sleeper... rx |

After my 14 is up just go into the bunk for 10 Thanks[/QUOTE Actually if you got a log violation for the exact scenario above, you are not in violation. 8+2+3= 13 hours, after 13 hours you was only on-duty not driving, unless after the 3 hours on-duty you drove then you would be in violation. You can be on line 4 passed your 14th hour, you just can not drive passed the 14th hour. What did you do after the 3 hours of unloading? Did you drive? Did you take a 10 hour break? Everything counts against your 14 hour period (lines 1,2,3 & 4) The only way to extend the clock is to have 8 hours or more in the sleeper. Since you had a 2 hour break you "could have" taken an 8 hour sleeper break at the end of your 14th hour (before it ended or after your loading time) and that would have reset your 14 hour from the end of the 2 hour break. The driving time in between the 8 & 2 would still be counting against your driving time. You should look at the sticky's that discuss the 11,14 & split breaking. It should clear up allot of answers

| Sleeping in the upper berth? On another subject, is it really illegal to sleep in the upper berth while your partner is driving? I've heard that it is but haven't found it in FMCSR (or whatever it's called). Does anybody know? Thx |

| not illegal but very unsafe. if the brakes are hit hard you will fly out of the bunk and can posibably injure the driver causing him to wreck. it's just a safety issue and common sense thats all. |
