My crew wants to drink after work

    So, I drive a crew truck that requires a class A. We generally spend most of our week on the road. When the day is done, we usually stop to grab ourselves a six pack at the gas station on the way back to the hotel. The rule has always been that no alcohol is ever allowed in the cab, so we put the beer in the trailer or on the bed. I was pulled in at the scales today and the officer told me that any alcohol anywhere on the rig can result in a $600 fine and 24 hours out of service. Have I been completely wrong about the law this whole time? If so, is there any way around this?

    I'm not sure but I'd play it safe by putting it in the trailer or something similar

    I would hazard a guess that alcohol anywhere on your person, company vehicle or whatever is against your companies policy, immediate discharge. Of course if an accident of any kind occurs, the DOT regulation is the least of your worries, testifying in court after getting fired is the tough part.

    To clarify, nobody drinks in the truck or on the clock, period. We all know better than that. The company has never had a problem with alcohol as long as it is outside of the cab and as long as no one consumes any until the day is over, which makes sense to me. I always thought that was the law anyway. I mentioned today's run in to the owner and he was as surprised as I was. I've since been researching to find the exact wording of the regulation and I can't seem to find it anywhere. It may sound silly, but have you ever tried to tell a construction crew living on the road that they can't have a few beers after work?

    I don't blame you. I have a beer or two when I get home from work myself.

    When I was otr I would drink when I'd stay in hotel rooms for my 34s.

    Ya, no alcohol at all in the truck or trailer. Just keep it out of sight. Most won't give you any problem. They know what your doing. Having a 6 pack in the truck with one missing and no can will get you in trouble.

    Also, if your on private property like Flying J you can drink yourself into oblivion just as long as your legal to drive later and no empties inside.

    Was at home the other day and bobtailed down to the grocery store to pick up some things. Meandering around the aisles, felt like a regular human being again and grabbed a bottle of fine red wine along with the other stuff. Didn't even think about it. But when I was loading the stuff into the truck it hit me. The 2 mile trip back to the house I was sweating like Henry Hill looking out for black helicopters following me.

    And that bites that it has become that bad. Remember the feeling well from the pvt fleet days......didn't dare even stop at a store that sold beer ( knowingly ) in co. truck or in uniform.....

    As far as I know bud absolutely no alcohol in a commercial vehicle anywhere unless it's freight . That's sleepers, boxes, open, closed, seats, bags, mty, full etc.

    Put a cooler on / in the trailer and enjoy later. I know I don't need to tell you to not even think of touching the truck after even one beer?
    And you did know sitting in the drivers seat is considered on duty ? Yes sir.....sure is....

    And my personal rule ( job security, paranoia etc) To report for duty I had to have 12 hours off since last drink. A personal policy I created and I refused to violate it for anybody or any reason.

    I don't buy the "in the seat on duty" thing where's the line on that? I live on 5 acres truck and trailer are 50 feet from the front door if I started drinking at 3 pm and at 10 I'm hammerd and want to go jam out in the truck with the wife your telling me I'm back on duty and DUI ? Don't think so if the trucks on private property I e truck stop,customer,back yard pretty sure your fine.
