Logging off duty when in sleeper. Yes or no?

    several of you are completely dead wrong in saying you HAVE to log sleeper berth. the green book doesn't say it either. I cant recall logging sleeper berth in at least 20 years.

    you are just repeating what someone else said or what a company said you needed to do( they can do that as company policy) look up and read 395.1 section g ,provision a , items 1,2 and 3. but here it is for those who wont look and refuse to listen


    a driver who operates a property carrying commercial vehicle equipped with a sleeper berth, as defined in 395.2 and 393.76 0f this subchapter

    (a) must before driving , accumulate

    (1) at least 10 consecutive hours off duty

    (2) at least 10 consecutive hours of sleeper berth time

    (3) a combination of consecutive sleeper berth and off duty time amounting to 10 hours or

    (4) the equivalent of at least 10 consecutive hours off duty if driver does not comply with 395.2 or 393.76 ( no sleeper on vehicle)


    and in the book it also states that " any time spent resting in or on a parked vehicle , except as noted in 397.5 can be logged off duty.

    nowhere does it state sitting in the drivers seat of a parked vehicle has to be logged on duty.

    its no wonder the old deal about white sheets persists to this day.

    I certainly can't find where it states that you have to log sleeper if you're in the sleeper. Sleeper time and off duty time accomplish the same thing. Another thing that kind of now is opening my eyes to this crap they're pulling is. He pulled out a 3 inch thick DOT regulations book and opened it right to the page and showed me where it says "Can a driver log off duty while in sleeper berth? No." Didn't get a chance to see the rest of the explanation as he pulled it away before I could read any further. Clearly it's a big scam. This big ### book and he went RIGHT to the page. Coincidence? I don't think so.
    Now that all these companies are going to EOBRs, they don't have half the violations they can write us up for, so they are looking between the cracks for crumbs they can grab. It's going to be useless to try a DATA Q as the same Nazi is going to review it (another bullcrap FMCSA bright idea). Like he's all of a sudden going to change his mind. Yeah right.
    And all of you stating on here "log it as you do it". What a bunch of crap. I'll bet none of you change your duty status from sleeper to off duty when you go to take a shower or take a crap or eat. Quit acting like you know all the regulations and rules because I can guarantee you that you can't recite any of the regulations by number or otherwise. I always log my time as off duty if I'm going to be in one place more than 10 hours or waiting around to get a load. I've had my log book checked more times than I can remember and this is the first time this has EVER come up.

    Just read this whole thing and it says NOTHING about having to log it the way the Nazi said.

  10. I must of met that same cop. My logs were clean and neat. He starts digging. And digging looking for errors. Then asks.
    Cop - Do you wear glasses.?
    Me - " I have contacts. "
    Cop - are you wearing them now.?
    Me - I have disposable contacts. A gust of dirt blew into truck I had to remove them.
    Cop - so your not wearing your " corrective lenses" as stated on your license
    Cop - here is your $395. Ticket

    No proof required. IF you have a receipt you're supposed to produce it. I just tell them I stayed with a friend. "Who is your friend?" "A friend."
