Logging off duty when in sleeper. Yes or no?

    The FMCSA has done one thing right in the recent rules revisions; that is recognizing that being in a parked truck is equal to being off-duty. Now they need to change sleeper-berth so it is only used when doing a split.

    show me the regulation where you HAVE to log sleeper

    but of course I posted the section, nowhere does it say you HAVE to log sleeper. the only time you HAVE to do that is when split breaking

    that exactly how the regulations read now, the only part in the rule that says you HAVE to log sleeper is the provision for doing split breaks.

    how did sleeper berth even come up?? did he say you had to log sleeper??

    He noticed that I logged off duty for 23 hours and asked if I slept in the truck. Naturally being an honest person I said yes. Gues honesty gets you nowhere nowadays.

    He didn't ask WHERE in the truck. I have never logged sleeper except when I do an 8/2 split. Have had various safety departments say it dosen't matter. Have never read where it says you MUST log sleeper..

    However that being said logging too many consecutive hours in the sleeper will get you a violation..I believe it's 15 consecutive or something like that. Obviously there are basic human needs that have to be attended to

    If your truck is involved in an accident and you get injured while in the sleeper, you're SOL if you're logged on the incorrect line. There are other liability issues involved too.

    Its not stupid to be given a log falsification violation. Log what you do and do what you log. Whether or not you agree with a rule doesn't matter. You still have to follow it.

    by that theory if you go use the restroom during your sleeper berth mandatory 8 hours of your 10 hour break
    you busted your sleeper berth provision and have to start over
    I am personally disgusted to have my name associated with what most of humanity uses for brain matter
