Need the solid truth - discriminated against for past health issues?

    I am not proud to disclose this but, here goes. I had a nervous breakdown and took short term disability to get treated. During this time, I hit rock bottom and attempted suicide. I ended up in the VA psych ward and at no time was I a danger to anyone else. Well, I have being in intensive therapy, outpatient, and diagnosed with severe depression and PTSD. I am taking medications and my therapist cleared me to work again. It's been a long road, but the VA saved my life. I got a letter from my therapist releasing me back to work as a driver. After I passed my recert exam my employer tells me that I am disqualified as a driver for 1 year and now I am forced to take a PT position as a dock worker. They said that it is a DOT reg and the medical examiner should have DQ'd me. The examiner said she was not aware of the suicide attempt and that it was true I cannot drive for one year. I have been a driver for 22 years. I have searched everywhere for this reg and cannot find it. Even called the state DOT officer and he has heard nothing like this. Is my company messing with me? Is this a judgement call? Aside from the fact that a select few drivers we have were part of my breakdown. I filed a harassment complaint with HR a year ago and told they would interview the witnesses to the harassment. Nothing ever was done, no interviews, nothing and these select few drivers continued their campaign to try and get me fired. They try to get anyone fired or in trouble and I finally snapped. Now, this was a small part of my breakdown but, it did contribute. So, am I being discriminated against or does this reg exist????

    First I want to thank you for your service.

    My recommendation is to look for a new company, and to leave this company. You don't need high school drama, I've noticed a lot of drivers still act like they are in high school. Some seem to even get egotistical about skill set, like how fast you can back up to a dock etc. don't waste your time.

    And don't think us as drivers don't have breakdowns as well, we do, it's the fact that you have ptsd and this job exaberates the problem because of the isolation and all the bulls($&&@) we put up with.

    can you continue doing this ? Do you enjoy trucking or is it too much isolation? I know a lot of guys with ptsd they need a good support group and to talk it out. Please stay strong and don't think suicidal.

    If you're cleared to work, apply other places and don't go into details about the medical problems. Don't ask;don't tell, especially about the suicide issue.
    Is that outfit you're working for union?

    First off its good you're here to tell the story. Depression and everything with it sucks. Also thank you for your service and the sacrifice you made. It's an honor to talk to you.

    There is no "regulation" Per SE, but the company (any company) wants to make absolutely sure that your mental health is ok. Remember that your breakdown was because of your job. They aren't discriminating against you. Just protecting their best interests and yours. I really hope all works out for you.

    Thanx for your service brother&I'm happy you got the help you needed&dealt w/your demons....take the dock gig for know to keep a buck or two comin in&yourself busy....Now start to look at companies in your area....do some research I'm sure there are a few w/vets in mgmt....Be honest(you have nothin' to hide or b ashamed of!)let them know your situation &everything you have gone thru to get right....Im gettin any one of these people will work With you...good luck&God Bless.....

    Wow, Thank you for all the support, and you welcome for the service. I am proud to have done it. I have thought of the same thing about looking at other companies in the area. As for the select few who get off tryiing to screw people, they have been successful in getting two terminal managers canned just because they didnt like them. They dug up some #### and called HR. They recently tried to nail the current manager but, he was prepared and stuffed it back down their throats. Thank you again for all the support and yes, I am taking it day by day.
