Considering the average truck driver is pushing 60 years old, the fact that white hair cannot be tested might be a non-starter issue with this method of testing.

Also, the article states that hair testing has not been able to withstand legal challenges because it is highly subjective and cannot determine the difference between environmental exposure vs past use, let alone intoxication levels.

But, some companies are already using it as pre-employment screening. If you aren't hired yet, you aren't protected by labour laws that would prevent you from being fired. As such, a company can put you through any number of flaming hoops like a hair follicle test and use basically any excuse not to hire you already.

Pull the hair from your sack if you have none on the hat rack.

I think urinalysis works just fine, which is why they've been using it all this time and it has effectively limited, reduced or eliminated drug use. There's no evidence to suggest a rise in drug use so why are we finding solutions for problems that don't exist?

In such a hyper regulated industry, I am leery of companies that wish to impose even more regulation beyond what is already mandated.

Would you want to work for a company that invented their own, more restrictive HOS refine and would fire you, even if you were DOT legal because you exceeded their HOS?

Or maybe instead of random drug tests, your company makes a weekly drug test for all drivers, cutting into your work week and forcing you to show up somewhere each week as if you were on probation?

How about setting their own, more restrictive weight limits and hiring security guards with radar guns to target your own company trucks (I know 2 companies that do this, btw).

Sure it's their company and they can do whatever they want but I'm not going to work for a company who pays people to come up with ways to further harass their own employees, even beyond what the government says is necessary.

When government regulates us we cry dictatorship! Socialism! Fascism! But when corporations do it, we just meekly accept that corporations know best, and it's just business.

All this will do is make sure people who have done drugs, quit, got sober, and have turned their life around, will never get a second chance. It's a joke.

Only people that get second chances in America now are movie stars and athletes!

A hair test might go back 6 months. I'm confused where this no second chance comes in. 90 days to 5 months isn't forever.

Since this desire to push hair testing came to the forefront, I am just waiting for the law firms to line up and take advantage of it. The Article gives them so much ammunition, and confirms my position on it since it started being pushed. If I was a aspiring new wanna be driver from Colorado, I would do a couple of doobs, head on down to a trucking school, get my CDL and apply to one of the carriers wanting to do the hair test game. Any use was before wanting to be a trucker, obtaining CDL, or application. it was legal in the state I was from. Employment denial over this would be like shooting fish in a tank for just about any but a deceased attorney. Character defamation and a list of other side issues and a lawsuit for big money. Man, If I was a newbie, wanna be driver, I would go with this in spades.
