operating a CMV has absolutely nothing to do with carrying concealed. If you are charged with illegally carrying concealed, there will be NO exacerbating federal charge related to the fact that you were operating a CMV.

I suppose it's possible some locality might have such a law on the books, but I'll believe it when somebody provides proof.

LOL and you know this for sure???? You commited a felony while you were operating a CMV....now granted I will give you......you wouldnt be using the vehicle directly in the comission but who is to say the court couldnt twist it....i wouldnt want to take the chance!

Absolutely NO LAW stating firearms cannot be carried in a CMV. None, not on state or federal level, and definitely not in the FMCSA.

HOWEVER, there are different laws varying from state to state mandating HOW a weapon may be transported. For example, locked up in a gun case with ammo stored separately.

Many states permit loaded concealed handguns to be transported IF you have a concealed handgun permit from your home state.

Not trying to start an argument here, just want to make sure correct info is being stated.

I have, since early in these postings, made remarks and rebutted replies concerning concealed carry and carrying a weapon in a vehicle. I have read many posts that seem try to treat the two as the same. I have stated laws and others have posted concerning this. Apparently no one reads past the last page.
Federal charges would stem from federal laws being broken. A person can lose the right to drive a vehicle for many reasons but carrying a weapon in a vehicle is not one.
Even if a driver carried a sawed off shot gun, which would be a federal charge, this would not bring a federal license charge. An exception might be using a firearm from a moving vehicle but this would still be a federal gun charge and a state license charge and not a federal charge. A drivers license is the property of each state CMV or not. However, a charge that results in a long prison term will, by default, cause the loss of a license, but can be renewed upon release.
I would also like to state again that there are no federal laws pertaining to carrying a weapon in a vehicle. In fact, the right to peacable carry is protected by federal law. There are restrictions in all states(state laws) concerning weapons in a vehicle and how they must be carried. An exception to carrying in a vehicle and federal laws would be trying to carry on federally restricted areas.
I would also like to inform all that, with the exception of some, a lot of states honor the right of ingress and egress of the federal highway system. This does not mean that Barnie will not see this differently though. This varies by state and is even in the truckers atlas. As stated, Barnie will probably not care but within the course of driving a CMV this may be a defense in court.
I am replying to this post on the fly as I am in a hurry to leave and hope I have not made any mistakes. If I have any corrections will be appreciated.
If anyone knows of "laws" that reflect differently I will be interested in knowing these. "PLEASE" only stated laws and sites not opinions as most are not correct.
Anyone wishing to research can read the many past posts as they are full of information, laws, and sites.
