If my start time is 2200 hrs and the company does not have ny load ready and I am waiting technically I am on duty not driving correct. They want me to wait and start my log when the load is finally ready. I could do it this way to work with they company But Why I have to wake up to gat to work on time. If I call ahead of time I still need to wake up early to do this. Every day is a 14 hour day I need my sleep and time at home. If I wanted these hours I would Be OTR. I am currently looking for a new job hopefully before they fire me for not wanting to work beyond 14 hours. ANY ONE IN THE CHICAGOLAND AREA BEWARE OF A AIR FREIGHT COMPANY THAT THINKS THEY SET THE PACE

Point them at the FMCSR, part 395.

395.2 Definitions

ON Duty Time shall include:

(1) all time at a plant, terminal facility, or other property of a motor carrier or shipper or on any public property, waiting to be dispatched, unless the driver has been relieved from duty by the motor carrier.

(4) all time, other than driving time, in or upon any commercial motor vehicle, except time spent resting in a sleeper berth

(5) all time spent loading or unloading a commercial motor vehicle, supervising, or assisting in the loading or unloading, attending a commercial vehicle being loaded or unloaded, remaining in readiness to operate a commercial motor vehicle, or in giving or receiving receipts for shipments loaded or unloaded.

( 8 ) performing any other work in the capacity, employ or service of a motor carrier.

In other words, unless you can crawl back in the sleeper, it's on duty time. If they demand you log it otherwise, tell them to put it in writing.

And look for another job.

Yes it's on-duty however if the company allows you to run to the store (example) or do what you want while you wait then you can log it as off duty.
But yeah hence the reason for the 14 hour clock is just this example above. You could be awake 12 hours waiting and they can expect you to run your full 11 hours of driving, however the book covers you and if they fire you then do a formal complaint to the FMCSA
