The Federal Motor Carrier Safety Administration has published a Notice of Proposed Rulemaking that revises commercial driver's license knowledge and skills testing standards and requires new federal minimum standards for states to issue commercial learner's permits.

Some of the proposed requirements include:
• successful completion of knowledge and skills testing prior to issuance of a commercial learner's permit

• all CDL applicants to have CLP for 30 days before applying for a CDL
• all CLP applicants be at least 18 years old before applying for a CLP
• increased documentation requirements for CDL and CLP applicants to demonstrate legal presence
• Disallowing the use of language interpreters for the knowledge and skills tests.

• a CLP holder meet virtually the same requirements as those for a CDL holder. This means that a driver holding a CLP would be subject to the same driver disqualification offenses as apply to a CDL holder.
• increased fraud prevention measures to be implemented by the state driver's licensing agencies

The NPRM notes that many of the program areas and issues dealt with in this NPRM are also addressed in the Department of Homeland Security's final rule implementing the REAL ID Act. FMCSA welcomes suggestions for clarifying both the commonalities between this rule and the REAL ID rule and the differences between them. The agency says it recognizes that further harmonization with the REAL ID rule may be needed before adopting a final rule.

Ron - you have PDF (adobe acrobat reader) installed? the link came up fine for me.

As for the listed changes, I think the only one I might have a quibble with is the first one - knowledge AND skills before you get your permit? This is coming across more like the waiting period for guns than anything reasonable for a CDL.

The way I read it, I'd have to go to school (or some kind of training), and pass all the range tests before I can get a CLP, then I'd have to get my road training in. So.. if we keep with the PDTI guidelines, I'd have 30 days in which to cram my 20 hours of on-street driving. 30 days in which I can NOT drive without an *awake* co-driver.

Actually, now that I think on it a bit more, it seems that what they're doing is trying incorporate the on-street training with the "training" and "orientation" trucking companies require. I don't think I want to even consider the problems with that.

As for the english requirement (or, no translators), I fully agree with that provision, too. Each and every highway sign in the US is in English. Each and every DOT officer speaks English. 99% of all business in this country is conducted in English. To be .. bad, English is the lingua franca of the United States. If you can't communicate well enough to pass a driving test, you should NOT be driving a CMV.

(in fairness, any US drivers going to Mexico (for instance) should have passable command of Spanish)
