driving over the limit, need help!

    I am new to this forum but i am not new to the road, i will be 24 next month, I got my CDL-B when i was 20 and went to National training truck drivnig school in Green cove springs, FL and got my CDL-A and graduated in Oct 2006 but still drivng a class B truck since. So here goes, I currently work for a metal company, im a day driver, im in Jacksonville, Florida, most of my deliveries are to tampa-orlando-daytona-melbourne but every once in a while they send me to Miami, Naples, Ft.myers or Pensacola and work my way back to Jacksonville which is over the 12hour driving limit, I've brought it up to my boss before but he says i dont like sending you down there but somebody has to do it. I started working there Nov 2006 and I just counted all my illegal logs over the weekend, the count is 36 logs that are over 12 hours behind the wheel limit. I do have another job lined up, I really wish would call me today and say im hired then i wont even show up tomorrow to do another illegal day which is 1 stop in Naples, 1 in Ft.myers, 1 in Sarasota and last stop in Tampa then its 4hrs back to Jax which means no going out on friday night due to a 16hr day. Any advice is appericated and sorry for the long post.

    Whats the average weight of your load??

    What "total weight" is your truck permitted to haul?

    the truck weighs around 14-15,000 and the gross is 33,000, its a 27 foot strait truck flatbed single axle.

    Several things here. Log books may not apply. And, LogsRus isn't able to get online today it appears, to respond to your post. She may be able to later...wait for her to give you a response on your logging issues.

    I'm using differant PC today, and can't crunch the route to verify the need for a log book.

    Other issues. Weight. Are you saying you guys are permitted for 33K ? Or are you saying that is the normal weight of the load?


    Do you guys run the 16K steer tires?

    Single drive axle = 20K restrictions...unless permitted.
    Steer axle = 12K restrictions. unless you run the heavier rated tires.

    Total = 32K total legally.

    Usually the gross weight permitted is affixed to the truck. Where it can be seen easily.

    my weight is not the issue, ive never been overweight. Im talking about my logs being over the limit not weight, sorry for any confusion. A fdot officer told me Anything over 150 miles requires a logbook. Im saying i have 36 logs in the 18 months I've worked there that are over the limit days and what can i do about it to have my work not send me on these illegal driving days, do I use the logs as leverage ans say i will turn in my logs to dot if you send me on another illegal or what?

    You can get yourself fired if you want.

    But since you are a intrastate driver. There are no violations on you or your company. Unless you have violated the "driving" limit restrictions. Which just happens to be 12 hours for you. And you can spend up to 16 hours doing it.

    Weight might get their attention. But a 16 hour day with 12 or less hours driving, will not.

    And under FL law, you get a full reset in 24 hours...of your 70.

    Ok if you are a NON-CDL holder then the regulations applies to 150 air mile radius.

    If you must carry a CDL then you must follow the 100 air mile radius.


    Either way you ARE allowed ONE (notice ONE) day out of 7 days that you can work a total of 16 hours.

    Any more than ONE day is not LEGAL! Regardless!

    The 100 & 150 air mile radius just states rather you have to fill out a log sheet or track your hours another way.


    If they are making you run illegal I would suggest reporting them to the Federal Motor Carrier and finding another job if you can. If you can't then stay there until it unfolds. I will say most of the time they will check your time cards/logs to make sure you are credible in your information (not to scare you, it's only an olds wise tale those who are telling are guilty themselves). What you need to do is not work illegally anymore, if that's what you are "really" doing.


    Understand you can fill out a log sheet for any days that you are working 14 hours a day. Also you can be on line 4 passed your 14th hour of work, just NO DRIVING!

    Good to see ya back :)

    But he's intrastate only it appears. And I may be misunderstanding him on his hours of driving.

    FL allows him to work 16, and drive 12. It does not restrict it to one day only per week. And it allows him to get a reset in only 24 hours.

    He still must take a 10 break after the 16. But, it appeared to me. He only done that once a week anyway. On Fridays.

    the truck i drive requires a cdl-B even though i have my cdl-A. I did not go to work today, my boss left me a message 30 minutes ago saying there going to let me go, today would of been about a 16 hour day no question about it, a 13 hours of driving easy which is illegal and im tired of them doing that to me so what can i can about it?

    Sorry to hear that. :(

    You could::::

    Take your logs to the nearest DOT, and report him. IF they do an audit, he may get fined. But, you take a chance of being fined yourself. After all, you continued to work for him during this time.

    Reporting violations of this type. Can be iffy at best most times. However, the DOT is starting to get serious with people who willingly allow or require their drivers to violate the law.

    One of the questions you will face. "Why did you wait so long, to report it?" Then, "Why was it not a problem, before you were let go?" Be prepared to answer them.

    While I'm certian there are many excellent companies in FL. I have found most to be unethical, and complete bottom feeders. Many make Swift look like a church gathering.
