100 air-mile logbook exemption

    Ok, I drive from Vancouver Washington to Eugene Oregon. I was told years ago that we are OK if it is just a few miles over. It's like 110 miles to most of the Eugene area. A Oregon Weigh Master said that it would be OK. But on of our drivers got busted for it last week. Anyone know what the official rule or what they really say about this little gray area? I really don't want to be doing a log book for days with up to 12-13 stops.

    Well I think if they want to be picky all they have to do is point at the regs where is says 100 miles, although to Eugene is really being picky. But from my old yard, which I think you have probably been to on Mcloughlin where the tall tanks are, just south of JD refrigeration, anyway from there to 6th and Chambers is 123 miles and if your driver is going anywhere in that vicinity from Vancouver thats another 10 miles right there.

    it is not 100 statute miles. it is 100 air miles which are the same distance as a nautical mile (6000 feet). so it is actually a little farther than 100 statute miles. I think about 115 statute miles.

    It comes up as 110 miles from our warehouse to the drop. Stopped by ODOT today and talked about the gray area. Things just change with technology. Google Maps! I guess it is time to learn all about log books. Just means $$$ in my pocket. Thanks guys for the help.

    i have one question that has probably been answered here on this thread but here it goes... im a local driver in the L.A. CA area but sometimes ill be asked to take a load to Oakland CA wich is about 394 miles one way, and yes i do fill out a local drivers "log book" but when i go up north i also fill out a regular log book like OTR drivers do, am i doing the correct thing or am i doing something incorrect????

    You can fill out paper logs even if u r local, however if you are driving I've 100 air mile radius you must fill out a log sheet and you can the. Follow the 11/14 hr rule but you do not have the 16 hr exemption as this is only for local drivers that worked within 100 air mile radius for the previous 7 days! If u fill out a log daily the. You can always log the 11/14 hr rules as to the 12 hr rule! I'm not sure this answered ur question but I gave It a shot lol! The question was kind of confusing to me but it's bed time ha ha

    I c the confusion now that im reading it all over again, the ? is am i supposed to turn in both logs together @ the end of the week to my "safety manager" ?????

    There are no requirements to enter in the remarks section of your record of duty status a "PRE" or POST" trip inspection.

    396.11 Drivers vehicle inspection reports
    ***This regulation is just that. A seperate document a driver is required to complete at the "END" of each days work on each vehicle operated. This document is the proof that the inspection was performed...

    392.7 Equipment, inspection, and use.
    This section instructs that the driver shall not drive a vehicle unless he is satidfied that certain parts and accesories are in good working order.h
    ***There is no requirement that the driver document this information in the remarks section of his/her record of duty status...

    With that being said, one may query "How will the driver prove to a stubborn officer that they did indeed inspect their vehicle in the morning?" Again this is not a requirement and I would reccomend to any safety supervisor who has a driver that has been CITED with that specifically as the violation to utilize the FMCSA's DATAQ's system to fight the citation and have it removed. This citation will not stand as there is no formal regulation concerning documentation.
