ICC# question

    Hello all,
    I am hoping someone here can answer some questions for me. I work for an accounting company and have a client that has asked us to find out some information for him. He is an O/O that has an ICC# , he is looking at leasing a truck from another O/O that does not have an ICC#. Our client wants to know if he can run the truck he is leasing under his ICC# or will the O/O that he is leasing it from have to get an ICC#. Hope I didn't lose anyone with this it really confused me in the beginning.

    First off- The ICC was legislated out of existence a good number of years ago. It is now administered by the FMCSA under the MC# (Motor Carrier) format.

    Yes, your client can lease a truck owner without an MC# under his authority. He needs to meet certain safety and legal requirements, such as sufficient liability insurance, record keeping, drug testing, etc.

    Correct Dweller.

    The ICC Termination Act, enacted in the 104th Congress (1995...sorry, I can't remember the Public Law ### from the 104th nor the 49 USC#) terminated the ICC on January 01, 1997. Motor carriers may no longer receive an ICC#. Most of the ICC rules were incorporated by reference into 49 CFR and may be found there under the Surface Transportation Board rules, and the applicable transportation modes.
