Drinking booze in a motorhome.

    I was wondering what is the law pertaining to consuming alcohol in a motorhome? As far as I know general DUI laws, the keys can not be in the vehicle when being under the influence, right?

    What about a motorhome? Say you are parked in an RV park and get smashed can you get a DUI?

    Number 1. It is not on a roadway.
    Number 2. Keys are not in the ignition in a motor home usually parked in a RV park. They operate off the electric in the park or the generator.

    Most States have exemptions for alcohol consumption in an RV.The vehicle must meet the States definition of an RV and this does vary by State law.The alcohol may only be consumed in the RVs living quarters and no alcohol or containers may be in or around the drivers area.Even while driving an RV your passengers may indulge in alcohol in the living quarters as long as it is not in the drivers compartment and not accessable to the driver.So,yes,you the driver can get plastered in a parked RV but only in the living quarters.And as roadmedic said don't park on or by a public roadway or access to a public roadway if you the driver wants to drink.Last thing,research the RV park.Most allow alcohol consumption,some don't.Also some State parks and Federal parks ban any possesion or consumption on their lands.

    FMSCA oversees interstate transportation only and many States adhere to the FMCSR rules for intrastate commerce.An RV does not meet the definition of a CMV.That said,no CDL is required and FMCSA rules do not apply.The only thing a driver of an RV is required to do is follow each States DMV laws regarding alcohol consumption and open container law.A driver who holds a CDL while off duty may drink as much as he can handle while in the living quarters of an RV but once he or she is back on the road or going back on duty the rules kick in.Vacation over.

    Whichwaywest thats not entirely true. A RV is considered an CMV when its being tranported between the factory-dealership and dealership -dealership.The reason I know this is I use towork for a RV dealership and transfered them between the the company's three yards and shows.

    Nothing is sacred, I worked as a Probation officer for a spell and had an offender who got a DUI at her kitchen table because the hood of her car was warm when the cops showed up at her house... #### Kids dimed her out... :yes2557:

    A friend of mine, drank a sixpack and :)biggrin_25525:), was buying Kerosene and the Speedway clerk called the police, who showed up at his house 15 minutes later, and wanted to interview him. i.e. haul him to jail- there was old collision damage on vehicle.
    Luckily, his dog, (dead two years now), would not let the police in the house, even though wifey tried to let them in, and 30 minutes later they left.
    Kindof off the original thread, but true.
