logs and trouble
Hey there, I have read a lot of the post and questions placed towards you but have one to ask that I have not seen. I am a Truck owner BUT not a driver so I am just trying to stay up to date on the 11/14/70 rules. I have a driver that wants to log everytime he steps out of the truck, or even just pulls over to check his map or get directions. I have explained that to my understanding that all these 15 & 30 min up to off duty or sleeper berth counts off on his 11 hrs driving time, 14 hr window AND 70 hour. He says he was trained by Swift and Arrow that it did not count on any. Which of us is correct??

I believe your driver is correct. The 11-hour limit is driving time and does not include anything not logged on line 3. The 14-hour limit is on-duty time and does not include anything logged off-duty or in the sleeper berth. Ditto for the 70-hour.

However, with the new rules, those stops also are not long enough to count as "rest" under HoS. All it does is "stop the clock" so to speak.

Also, if a rest stop is less than 15 minutes, he can just note it in the notes section without recording a change of duty status.

I should point out that I am not a law enforcement or government official, and this is just my understanding of the law. I should further point out that when I was a truck driver, the old HoS rules were still in effect, so there could be caveats in the new ones I'm not aware of. But I believe your driver got it.

Does not stop the 14 tho. Tick-Tock
11 hours of driving. Can not drive after you been on duty 14 hours, but can do line 4 after 14 hours. Going off duty stops the 11 as long as you don't bust the 14. Anything less than 15 minutes you can just flag. (line 4)

The only thing that counts towards the 11 hr rule ( Line 3 driving ) is driving, however a driver may not drive after being on duty for 14 hours.

If you want him to log everything legal then he has to log each of those 15 or 30 minute breaks. Line 1 and 2 do not count off on 11 hr or 70 hr rule only the 14 hr rule if less than a legal 10 hr break. The only things that count towards the 11hr and 70 hr rules are line 3 and 4. As the truck/business owner you are as responsible as him to make sure his logs are legal. If you were audited you could be fined as well as him for any violations. If your not sure of the rules and regs it would be a good idea for you to learn them.
