ADVICE NEEDED -bad report on my DAC

    Let me say I never figured I'd have to write this but......I just got fired.

    I'll keep this brief.....
    had my CDL since March 2007, never an issue, no tickets, no accidents, no out of service violations, never late for a pick-up or drop....nothing.
    Now, I start with a new company on March 30th, drive for them for 6 weeks and my career is screwed. First off, I was sleeping at the J in Kingman, AZ and was hit by another driver. I have the police report, I was legally parked, should be no problems for me. Next, I drop a trailer in Indiana, pick up a load and deliver on time. The next day the comapny says, what did you do to that trailer you dropped? I said nothing, why? Long story short, I had stopped at the Pilot to grab a soda and a sandwich and someone must have hit me while I was parked. I never even noticed it, ran to the customer, checked in with the guard, dropped and hooked. The safety guy called me in on Monday and said that it's obvious someone hit me but since I didn't report it I was being terminated.
    I said how can I report something I never even knew about? Now, I'm looking for a job and got turned down, I asked why and they said that my MVR is perfect for the past 19 years, but my DAC has an accident and says I was terminated for failure to report an accident. What the hell am I supposed to do now? DACFIX is $169 dollars that I don't have. Is there anything I can do? Sure appreciate any help you have.

    first dispute it in writing to dac next NEVER walk into the building and come back out and drive away without a walk around inspection of your truck

    on your computer, go to USIS.com scroll to bottom of the page. look for consumer,, click on that, it will take you to where you can print off pages for rebuttal on your dac, its free, you can get your dac report from there once a year free. try that and see what happens.

    If you did a 49 CFR part 392.9 inspection you would have discovered it like 112racing said.........Sorry but I don't think there's much anyone can do for you. You can appeal to USIS/DAC but what can you say, "I didn't notice any damage"? That implies you didn't check your equipment. And what will appear on your USIS/DAC is the original statement from the carrier plus your rebuttal.

    But I do in fact wish you success in your endeavor.

    Firstly, how do you know somebody hit you at the Pilot?

    A few months ago I witnessed a yard jockey rip the landing gear off a trailer... I suspect the hydaulics failed and it didn't appear the clown bothered to hook up air lines.

    What I'm getting at is this, isn't it possible the damage could have been done at the drop after you left. I've seen stranger things happen.

    This is EXACTLY right !!!

    Had it not been for another driver witnessing a yard jockey ripping the side of a CFI trailer, then calling CFI safety to report it. The driver who dropped the trailer could have been fired.

    The yard jockey reported it as having prior damage to his super, who in return called CFI for repairs, saying the driver had dropped it in that condition. :biggrin_25510:

    This point was driven even further home for me, when I dropped a load at Goodyear in Terrel, TX.

    We had empty 2 trailers, both with severe damage in the top left corners. After walking the line, and checking the other lot. I found a total of 8 trailers, some from other companies, with severe upper left hand corner damage.

    Of course nobody knew jack about it, when I confronted the customer about it. Per my companies instructions.

    It sounds like you need to learn to inspect your equpiment, anytime you leave it even for a quick run into the store.

    The question as I understood it was what to do NOW, not to go back in time and keep it off the report.

    Anyway, you find yourself in a familar position to lots of truckers. Your time to work with DAC-using companies has now come to an end. Search the ads, use that list of craigs, go in person to local companies and find a company that is either too cheap to use the service or sees it for what it is, a bunch of hooey.

    Pharm Phail is correct. Not much you can do about it now. Most companies that use DAC only use it for purposes such as these also. I worked for 2 companies that both used DAc and the only thing that they would report is if you had a "mishap" or and accident never anything like 300,000 miles driven accident free. Go figure. Anyway alot of companies out there that don't use them good luck. Who was the company that you worked for?
