Positive drug tests

    I thought I’d bring this up as two drivers have been discovered to have committed multiple violations regarding positive drug tests.

    Driver one failed a random drug test was terminated. Discovered driver at subsequent employer, contacted employer requested application, pre-employment drug test, pre-employment drug test results, previous employer checks, and form required by 49 CFR Part 40.25(j).

    Driver one falsified two applications in violation of 49 CFR Part 390.35:

    Application one: Driver listed employers up to 05/2008 leaving off employer from 05/08 – 07/08 where he tested positive.

    Application two: Driver listed being employed by a carrier from 05/08 – 09/08 when in fact he was employed by the carrier liste4d from 07/08 – 09/08.

    Carrier listed on application number two will be prosecuted for Part 390.35 as well as they signed employment verification sheet indicating driver was employed from 05/08 – 09/08 when the driver was actually employed by the carrier from 07/08 – 09/08.

    Driver one will be prosecuted for Part 382.215 for driving after testing positive and 390.35 falsifying a required document.

    Driver two falsified form required by 49 CFR Part 40.25(j) regarding positive pre-employment drug test. Driver checked “No” when answer was YES.

    Driver two will be prosecuted for Part 382.215 and 390.35.

    Drivers be advised once you test positive that’s it, you’re no longer qualified to operate a CMV that requires a CDL. To become qualified to operate a CMV that requires a CDL you must:

    • See a Substance Abuse Professional
    • Have a negative return-to-duty test
    • Receive at least six follow-up tests in 12 months with the time frame chosen by your employer

    There is no statute of limitations, both drivers identified were from drug tests in 2008.

    Sage advice…. Do not do drugs if you want to remain employable. I can almost assure you the employers contacted terminated the drivers shortly after they received the call and determined what happened.

    It's simple, If you drive don't do drugs. If you do drugs don't drive.

    I seem to always get the random drug test. I have never did drugs in my life. I started to wonder whether they thought I was on drugs or knew that I wasnt and always sent me to be safe. That way they met there requirements and nobody got busted.

    I will never understand guys testing positive when they know they have a CDL. Never, never will I understand it.

    What's even more amazing is the idiots that get knicked on the mandatory test at the beginning of school/orientation.

    You KNOW it's going to happen, how the heck could you not figure out you need to stop the stuff before you came?

    Ah well, if they were geniuses they wouldn't be on drugs, I guess.

    I always wondered about those guys too...

    I've done a few (too many) drugs in my life (coke, crack, pot, acid, pills)...but I always had enough sense to pass the pre employment screen.

    For that matter...I've never failed a drug test (hair or urine), even a random one (don't ask me the secret...I won't share it)

    I've been "clean" for 8 years now...but I do still miss the high at times, once an addict, always an addict...you just learn to say NO, you never get over it. Coke and crack was a hard habit to kick...but I did it all on my own, no rehab...no help (except from my wife).

    Good women are hard to come by...I got lucky, she saved my life. She never once said "you're gonna quit or I'm leavin..."

    She said "You're gonna quit and I'm gonna help you"...how can you say no to that???

    EDITED TO ADD: NEVER did my family do without anything so I could buy drugs...NEVER. I never was that much of a low life.

    And I realize that post strayed a little bit off topic...but I figured most of the people that read it could use that info....IT CAN BE DONE.

    Psst. I gotta secret on how to pass drug tests every time, without fail. DON'T DO DRUGS!!

    To Ridgerunner: Mad props to you and your wife for helping you. Max respect to you! Congrats. Now if you could give some tips on how to get an extreme pothead (by extreme I mean all day, everyday) to kick the habit when he doesn't see a problem, I'd right appreciate it.

    Well, short of beating him with a big stick (tried that already), I'm out of ideas. Just wish he could have followed me into "dumb guy stuff", instead. I street raced when I was younger. Not safe, I know, but none of the group I hung out with had any interest in drugs, alcohol, or anything else that would take the "edge" off of our driving. Old muscle car club, too. Not the rice burner "tuners".

    I don't know what to tell you for that...I had realized it was a problem even before my wife told me I was going to quit...I just wasn't strong enough to say it out loud (<<< its still hard to admit that...I take pride in being strong, inside and out.)
