CDL driving privledges taken away...

I got a ticket in January of this year for going inside I-285 in Atlanta and went and paid for it last week. I was made aware of a ticket that I had received in the same county back in 2004 that I hadn't paid for. I'm surprised the ticket was still open. My wife went and paid for the ticket this past Monday. Well yesterday I received a notice in the mail saying that my license was still good, but that I could NOT drive a commercial vehicle for 120 days.

The reason? I got "caught" with having 3 tickets in a 3 year period. I had gotten 2 tickets in 2003 as well. If you don't know, when you receive a ticket, it does NOT go on your MVR until the ticket is settled. Well when my wife paid my fine, it was then settled and it immediately went to my MVR and teamed up with the 2 from 2003 to give me 3 for the 3 year period.

Here's my question: These tickets were from 5 and 6 years ago. And even more so, they were all received 3-4 years BEFORE I even got my CDL in the first place. I'm wondering if I went up there and talked to them on that thought if there would be a chance my "sentence" would be reversed. I'm also wanting to ask if, if the previous doesn't work, I can take one of those defensive driving courses to remove points/tickets and if that will remove one of those tickets so I can get back in "good graces" with the DMV.

Lastly, I think I'll check with one of these trucking lawyers to see if he/she can help me out and "save" my license. I don't have time to wait 4 months to startdriving again. I hold one of the best positions in the company I work for and love my job and really don't want to lose it. Not just because of the money but also because I love what I do.

And I don't think I'll be released from the company. I believe they will put me to work maybe dispatching or some other around the terminal work until I can drive.

What do you folks think? Thanks for listening. This has me really, really antsy.

1. Talk to you manager immediately.
2. Get together with you co. lawyer and see if they can help you before you go spending you own money on an outside lawyer.
3. Prove to your employer that you are serious about staying employed with them.

Will any of this work, who know's. Though if you don't try, you will never know at all.

Doesn't matter, they where settled AFTER you got your CDL. So that is the lic. the go on. So you want to spend a few hundred dollars so he can tell you that he can't save what is not lose. you still have a license. You just can't drive a CMV for awhile. I think you did the crime now learn from it and do the time. It could be much worse. You could have had your license revoked for 6 mos. to a year.

My question is.... How do you not know you got a ticket?

Does the ticket fairy hand them out to municipalities during economic hard times? Or is it by public lottery?

Well you're thinking wrong as I have lived in the Atlanta area for the last 30 years and know all about it. I'm a daycab/local driver now and am in and out of the loop multiple times a day. I was using it as a cut through this time and got caught. Even told the officer that I was cutting through. I'm not asking about this ticket, though, as I knew I did wrong, and paid the fine without trying to get out of it.

I think I explained pretty well in the next paragraph of my initial post. These tickets were almost 6 years ago. I don't keep up with past tickets (especially from that far back) and wasn't expecting to see that letter come in based on tickets that far back.

I'm all for doing the time. If I have to. But there is no harm in checking up on this and seeing if I have a way out. If not, I'll do what I'm supposed to do. I'm not one of those folks that posts up getting caught in the wrong and crying that it isn't my fault. I appreciate your time and response.

You say you don't keep up with tickets that far back. (6 years) What do you do when you receive a ticket? Just throw it in the drawer and forget about it? Kinda strange for a commercial driver.

It does not keep states like MS from placing a warrent for your arrest on your file

Reading is not your forte, no? Try it again. You'll see where each of the three tickets were received 4 years before I ever even got my CDL.

danc694u. The case/ticket has to be closed before it gets sent to warrant division. For some reason (lucky for me), this particular case stayed open. They informed me of it and two days later, I was back up there paying for it.

Well it sounds like BS to me. If the ticket from 2004 was not "settled" or "offically closed" till now then it's not 3 tickets within 3 years. Any good lawyer should be able to get this easily dissloved. JMO

I also think you should pay closer attention to your tickets and driving.

You got lucky. MS issues the warrant the same day as your court appearance, if you fail to appear.
