overweight tickets

    They won't raise the rates. They'll replace you with new drivers willing to work for less. New drivers with nice clean records since they've never driven before. What could go wrong.

    yatista the the only tickets i am seeing that will affect your rating are accident related tickets reckless driving etc mechanical.since i still do not see where you see overweight violations specifically could you please copy and paste again?thanks

    Seems like your asking for quotes time after time doesn't make sense to me either! I'll try it in English for you one more time.


    Basically any and All Roadside Inspections as well as any other violation are a pass/fail test of you and your cmv. A weight inspection whether at a temporary (portable) scale or fixed location is a violation of the law. It's pass/fail,period. Just because in the past sometimes a scale would let a driver slide for slight overages it has never meant they had to. If they pull you around back it is a failure to pass inspection and therefore will affect the driver's safety rating, period. The rules do not have to spell out every individual item that is included. For example the law about inoperative lights does not mention every individual light on the tractor/trailer but if any one of them is inoperative it's a failure of the inspection. A "slight" leak in an air hose is a failure of that hose inspection, a 1/2 flat tire will fail an inspection, a damaged or missing wiper blade will fail the inspection; the LAW doesn't spell out those particular circumstances but they are still a pass/fail situation and would Not pass inspection. No matter how much you want those two overweight incidents not to count an YOUR safety record they are already part of it. Your are now being rated as well as the company. As I posted in an earlier thread like the song says..."People get ready"...it's already started and those 2 infractions will stick with you until 36 months have passed.

    well i guess you have your interpretation on this matter.as far as the rules being i do believe they are very specific on each item wipers tires lights etc but that is how i interpret the FMSCA rules.just like a bible 5 people could could read a chapter and each one of them would come away with a different interpretation as is the case here.Regarding your comment on me asking for quotes you were not understanding what i was asking for why would i ask for quotes of myself?come on lets be real here.I asked at least 5 times for someone to show exactly where it stated anything about overweight violations in the new system which as of today has not happened.Just a driver asking for help and it seems like that is not possible here.As stated previously in this thread i have spoken with Texas DPS and the overweight violations do not count on the driver they are considered non moving violations when there is no accident or incident involved.Also i do not believe i ever stated that i did not want those to count on me i believe i asked a question if they do count.Maybey a driver with your extensive knowledge could make some phone calls and verify all this info on overweight violations that YOU believe to be true and double check YOUR interpretations on this subject because i do not believe personally that anything is vague as far as individual rules concerning roadside inspections i will make another phone call to the DPS office in Austin Texas to make sure i did not hear them wrong the first time maybey they just dont know anything about CSA 2010 yet thanks for your help in this matter

    That's probably the case. Consider the mess with Minnesota... the state DOT has been enforcing FMCSA rules via tickets with no legal authority to enforce those rules since before last March. I wouldn't expect the gov't (feds or Minnesota) to feel any responsibility to clean-up their mess before they run some otherwise good drivers out of employment via CVSA2010.

    I received a reply from DOT. The fellow that responded to me said he will answer my questions specifically, however in the mean time sent me some links for me to go over...and there are quite a few of them.
