CSA 2010: How will the Driver Rating System affect you?

    How are you going to be affected by the new rating sytem. Will you change how you look at your pre-trip, or how you respond to "just run with it, we'll pay the fine if you get caught."

    The new system will be implemented over the next 8 months and some predict that up to 175,000 drivers will be declared unfit to drive based on the previous 36 months of DOT inspections, citations and the other criteria.

    What will an O/O do if found unfit. No company can hire or lease him to drive without jeopardizing their own operating authority.

    If they've been doing it right this won't affect them. If not, It looks like a lot of guys are gonna be looking for work in other industries!

    It will have no effect on me...We have brought this on ourselves by not cleaning up our own act over the last few years. I have seen this coming since the eighties. Myself? In thirty six years and over three million miles I have only had a couple of tickets and have never failed a DOT inspection! I'm not any different than anyone else here except that I refuse to run poorly maintained equipment or not keep the books squared away. It takes self dicipline and attention to detail.

    For me it's not the DOT as I've passed everyone in the past 6 years but now as for tickets I do have 2 in the past 3 years. I've pretty much gotten to where I'm logging with in 15-30 minutes of fuel and pre pass and within 15 on my fuel tickets and most Qcomm messages!

    My problem might be if I get this next job that I'll have to do the LP and that's gonna be a tad bit different! If the loads are there I know I'll be able to stay within my new set limits! It used to be I'd log it the way I wanted to but now that DOT is throwing the fines at me and at $1000 a pop on logs alone it aint gonna happen! I'm in this to MAKE money not throw it away to the DOT!

    As for the maintenance I know what to do and how to keep the truck up but it's still gonna come down to the money! Is it going to be there when I need what need to be fixed fixed?

    Us older hands are going to have to learn new tricks such as logging legal and keep the foot out of it to be able to fit in to these new rules or fade away to learn how to ask the big question "do you want fries with that?" I'm just glad that Ohio and IL have seen the light and put the speed limit to where it needs to be! Now if only those fall into the ocean states out west will do the same!

    As important as this is, drivers seem to be more concerned what radio comes in their new truck! This is going to have a large effect on trucking, and we as drivers need to be on top of it. Yes, there are going to be some job openings, lotsa them, coming soon.

    Does anyone know the origin of this new system? any chance this is being supported by the ATA and the big companies as yet another way to push more American drivers out of the truck to further their justification for bringing in the cheaper foreign drivers? Or am I just being too paranoid?

    What does this mean to me as a Driver?
    • For the first time, each commercial vehicle license holder (YOU!) will be assigned a ‘Safety Rating”
    • YOUR safety rating will follow you regardless of the company you work for or contract with.
    • YOUR activity on the highway, i.e. roadside inspection violations, accidents, tickets, even warning tickets will have a negative impact on your personal safety rating.
    • YOU could be declared UNFIT and lose your ability to drive for a living as a result of a poor safety rating. Companies will HIRE and FIRE based on your safety rating.
    • YOUR PAY could be affected as a result of a poor safety rating. Likewise, you could earn MORE with a favorable safety rating!!
    Safety Ratings will be based on 7 BASICS. (Behavior Analysis & Safety Improvement Categories)

    What are the 7 BASICS?
    1. Unsafe Driving — Dangerous or careless operation of commercial motor vehicles.
    2. Fatigued Driving — Driving commercial motor vehicles when fatigued. This includes hours of service violations
    3. Driver Fitness — Operation of commercial motor vehicles (CMVs) by drivers who are unfit to operate a CMV due to lack of training, experience, or medical qualification.
    4. Controlled Substances and Alcohol — Operation of a CMV while impaired due to alcohol, illegal drugs, and misuse of prescription medications or over-the-counter medications.
    5. Vehicle Maintenance — CMV failure due to improper or inadequate maintenance.
    6. Improper Loading/Cargo Securement — shifting loads, spilled or dropped cargo, and unsafe handling of hazardous materials.
    7. Crash/Incident Experience — Histories or patterns of high crash involvement, including frequency and severity.
    What are the Ratings?
    1. Continue to operate 2. Marginal 3. Unfit

    As a driver you can not afford to get an ‘unfit’ rating. That means you can no longer drive a commercial vehicle until that rating is improved.
    It is very difficult to improve that rating. For the most part you would only be able to WAIT until enough time goes by that a ticket no longer falls within the 36 month evaluation period.
    Where do they get the data?
    Data used to calculate your safety rating comes from Roadside inspections, traffic violations (citations) and crash data. A new Driver safety rating will be determined EACH MONTH! What can I do?

    AVOID ROADSIDE INSPECTIONS!
    • 35% of Roadside inspections are triggered by speed. By not speeding, you will avoid a speeding ticket and a roadside inspection.
    • 31% of roadside inspections are triggered by observable defects (brakes, lights and tires). Make sure you do thorough and routine pre-trip component inspections. Don’t make yourself a target for a roadside inspection!
    • Participate in as much safety training as you can. The more you learn and re-enforce safe driving behavior the better driver you will become. Make sure you maintain a top driver safety rating and you will ensure a successful career as a professional driver.

    Using my recent experience of my tire that the company refused to replace even though it was obviously bald (see the pics on my other thread "Running 99% legal") if I would have presented my truck at a weigh station and "turned myself in", the resulting inspection and OOS order would be counted against my safety rating???
    HOW THE HELL IS THAT RIGHT? I tried to get it fixed, took it to a certified mechanic, he advised my company to replace the tire and still they refused (I have documents proving all this!)and somehow I can still be punished??? and screw up my carreer b/c my company is too #### cheap to do the right thing??? What should I have done in that scenario if the company persisted in their refusal???
    And please dont tell that I shouldnt be driving for a company that wont take care of their equipment! I know that already and you are right, no one should work for these bottom feeders but, given the state of the economy and my "unstable" work record, I dont have the luxury of choice in who I get to work for anymore. I am lucky to have this job!

    I think you summed it up well. This is new to me as well. I don't know what the answer is Dave. But from what I read tonight I think your summary is correct. Sounds like in your scenario that you are stuck between a rock and a hard place.

    dieselbear, while I dont like your answer, I really have to say thanks for being honest with me!
    It just stinks that once again the law is targeted at the smallest player.in this game! As drivers we stand to lose the most and can afford it the least!!! The company, who more often than not created the problem, gets away scot-free and the driver takes the beating. And when the driver loses his safety rating, the company just finds another sucker to replace him!!!
    Please tell me I'm not the only person smart enough to see the flaws in this system!
    It's like a doctor trying to over-medicate the patient and ONLY treating the symptoms and NEVER EVEN LOOKING at the disease that is the cause of all the symptoms! This is just stupid times 10!
