    Clearing out a CDL disqualification

    i'm having a problem in getting my cdl in florida again. I held a cdl from indiana from 1999 to 2003 when it expired. I didn't make it in the industry very far so just stayed home in texas and worked there. Since I couldn't afford to transfer the license and all that I just let it lapse and let my DOT physical lapse, not thinking anything of it. now almost 10 years later, I am giving trucking another try. so I went to take my written test all over again so that I could get my learner's permit for school. Now the florida dmv is telling me that they can't issue me the permit even though I passed the written part until I clear up whatever caused the problem on the indiana license. Indiana says that they need a letter from the florida dmv saying that I am fulfilling the testing requirements all over again. So I talked to the supervisor at the office where i was trying to get my license and she couldn't help me with that because she didn't have anything like that to send. Gave me the florida dmv customer service line to call and i got ahold of them and told the guy my problem, and he sent what i thought at the time was what i needed. went to license office yesterday morning cause it wasn't cleared up before office closed the day before. still not cleared. called indiana dept. of Revenue, which handles the CDL related stuff, and the rep i spoke with said that the other rep isn't showing as having received anything. called florida dmv cs again and they show as having sent something, but that they had sent a clearance letter, which as the lady explained it to me, only says that I am eligible to drive and not much else related to my particular problem. The thing that is holding me back is that Indiana disqualified my license because the DOT Physical had lapsed. I knew that that physical only lasted for so long, but hadn't been made aware that if I didn't keep it up to date that it would cause this kind of trouble. I know that ignorance of the law isn't an excuse. Any advice on clearing this problem up? the Florida DMV CS rep yesterday said that i should be able to clear it up by faxing my MVR to the people in indiana. According to the Indiana BMV or DOR this disqualification was put on my record in 2001. Therefore, shouldn't it be off my record and not be affecting me now?

    BTW I already knew I was going to have to go the nine yards to get my license all over again, so I don't see why this would be an issue after almost 10 yrs

    i spoke with the florida dmv headquarters customer service as well as indiana bmv who directed me to the dept of revenue who handles the cdl related stuff. according to the indiana bmv, as far as they are concerned the license shows valid even though A) it is expired since 2003 and B) showing that I am ineligible in the records because of the expired dot card. the indiana bmv people did see that it was disqualified but as much as said they couldn't tell me how to fix it since the dor was the people to talk to.

    Dept. of Rev said I could either go to a branch and take all the tests and physicals and be done or the letter from florida dmv saying that i am doing the above

    Oh really ??? These people can be anal...for 30 years or more.

    You're most likely going to have to walk it through the entire process. And you may still need some outside help.

    Let me give you an example. Held MS license in '79, OK in '80, MS again in '82, TX in '83. Reverted to MS Commercial in spring of '85. ALL previous license were surrendered in MS every time I moved back.

    Stopped for speeding in AL around '88, license held in lew of bond, then mistakenly sent in with surrendered batch to MS.

    At which time it took almost 6 months, and a lawyer to prove I didn't hold a AL license....nor did I hold a OK, or TX license. Oh yes...they wanted to know about ALL of them.

    This even came back to bite me in the ### in 2003.

    Your MVR, or record, does not clear every 7 years like a credit report will. It stays on there FOREVER. So you must deal with it...Sorry......

    thanks. i know that mvr is different from credit..and i do know that these people can be pretty anal about things. just trying to find out what to do because all the resources that i have been pointed to so far have been useless... I was told by Indiana to send them a letter saying that I am going through everything all over again on Florida DMV letterhead... Florida dmv says they dont have that kind of thing to send and to get my mvr to prove it.. spent 15 dollars and it doesn't show that i have taken the written test for the cdl, which i did and passed. i need the permit to go to school, and i'm thinking now that the only way to clear this up may be to do my DOT physical and get it out of the way and send them a copy. Just trying to find out what to do

    Just an update.... apparently the issue got cleared over the weekend.... I can now go about learning to drive a truck. i got my permit today. thanks for the help

    My husband got A DUI in a regular car and went into ARD his CDL has been disqualified for 1 year does any know anybody who got it back sooner then that one for a DUI?

    Fed Reg's say that if you have a CDL and get a DUI your CDL must be disqualified for one year. Even is a car. The state has no choise and nothing to say about it.§383.51 Disqualification of drivers

    Note that if he dose it again he will loose his CDL for life.
