truckstop reset

This may sound like a darn silly question, but...here goes.
I just got my authority and and hit the road this morning with a 600mile run. I was telling a friend that i could be in a truckstop by my destination in time saturday to reset my 70 hours before i unload monday morning, he tells me he heard from someone else that there is no way to reset my 70 hours from a truckstop. I haven't driven otr since 95 so i,ve always been home on weekends....did i miss something?

That someone else is speaking from the "letter and intent" of the law.

But in answer to your question. Yes, you can reset in a truckstop.

Well, however you word it, 34 hr reset or whatever, you can take your time off anywhere you like. At home, in a motel, at your girlfriends house, in your truck at a truck stop, partying in Vegas, sleeping in a lounge chair at the mechanics shop etc.

Thanks driver I needed a good laugh today! You can reset your hours anywhere you choose.

This is what I suspect is going on with the scuttlebutt passed to the other driver.

Do you recall the "split sleeper" ruling and enforcement that was going on, when we first made modifications to the HOS?

DOT were claiming "unvalidated split sleeper", while they were handing out tickets in LA and other states until the second modification of the HOS.

EVEN if a driver had just left the house after a week off, they were being found in violation of the "split sleeper" rule. And were shut down for being over on their 14 and 70.

Not all officers were so anal about this "ruling". But they were out there.

So here we go with our tweak of the day...

How to you exit or gain entry to the sleeper ?? By stepping into the cab area, and plopping your butt down into the seat. Generally the drivers seat. And what line are you required to be on if your under the wheel, but not driving???



Now, we both can argue this is an extreme interpretation. But it has resulted in at least one ticket that I am aware of. This case was published in one of the trucking rags we find at truckstops, a couple of years back.

Personally, I find it hard to believe an officer would even pull such a stunt. But I've never been the brightest crayon in the box.

Ask said LEO how long it would take him and his fat arse to get across the drivers seat! Then hand him the log book and your FMCSA book and have him SHOW YOU where there is a 1 minute line to draw! You did NOT spend 7.5 minutes getting across the seat so take the ticket, your FMCSA book to court and get the DA to prove you wrong! Then put your case up and put a chair in the middle of the court room have said LEO walk up to it from the left side while you starta stop clock then get on his knees, pull this butt up to the chair then stand up and move to the right rear of the chair. LESS THAT 10 seconds (unless his arse was bigger than it should be) Then ask the LEO how "legal" your book woud be with 15 minute increment marks on it! Then put into evidence a logbook page or actually several from different manufactures and ask the JUDGE to show you where there are 1 minute marks!

That ticket can and has been beaten in court! They give these "no show" tickets out thinking you wont show and that's nothing but profit to the county!

Now CSA 2010 is right around the corner starting on Jan 1, 2010, If you PAY this ticket by signing and sending it in it will then go on your CSA rating which is just like a Safe Stat score for companies. You now have 1 mark along with any other tickets or DOT writeup you might have. It's now time to CYA and thts how you fight it your self or pay a lawyer!

If I had some moron wanting to write that ticket up I'd just tell him I had an arm full of stuff and went in the PASSENGER door and that would be the end of his little power trip!

I thought it might have something to do with being relieved of all duties and responsabilities, kinda like if you log a lunch as off duty or on duty not driving!
i think i'll just be happy i gave someone a laugh,, got my question answered, and leave it at that.

technically we're still on duty in the sleeper. you are not relieved of very many responsibilities in the sleeper. Just the responsibility to not sleep...

According to my off duty authorization letter, if i am eating lunch in a truck stop (line 1) and someone steals the truck...if i locked it....it aint my problem.

If someone tries to steal it when im in the sleeper...it definitely is my problem?

Technically no... If your in the sleeper... Your not on duty. Your in the sleeper....

Whats a off duty authorization letter? Never heard of one of those... If I want to go off duty, I do so. I don't need no authorization & I don't need no letter.
