It really helps. The case has lots of political stuff in it. I was the 1996 and 1998 Republican Nominee for US Congress, Missouri Sixth District. The Democrats (I do not change my beliefs but the parties do) ask me to run as a Democrat in 2004. When I was lead off to prison, three Television Crews were there to film the event. A little word of advice, if you ever go to prison, try to sneak in. You dont want to be famous in prison.
Missouri law ends Child Support different ways. Number 1, child dies. Number 2, Child gets married. Number 3, Child enters Active duty in the Military. Number 4 child becomes self supporting and moves out. Number 5 Child turns 18 unless child is going to school. If he or she goes on to College they must enroll for and complete 12 hours per semester.
My argument was my son had entered Active Duty by joining the National Guard and going to Basic Training. At the time the military gave you different color of ids. His was GREEN which is for ACTIVE duty. As a Veteran (Vietnam ERA not Vietnam), I can garantee you that Basic Training is Active duty. It is possible to join the National Guard and never go to Basic. You can actually retire from the Guard with no ACTIVE Duty. For example, you can be hired to look after the Armory. They do this for police officers in small towns. The Judge didnt care. He said that National Guard is not Military, just a "part-time job." I then went on to the part about him going to college. I said your honor, he enrolled in 13 hours but never went to class. He did not complete the 12 hours required. So even by that standard he should have been emancipated on his 18th birthday which was three days before he went to Basic Training. I knew all this because he was living with me at the time.
Now, this is where I made my mistake. The judge looked at me and said "Mr. Bailey, I do not know why you are defying me." I said,"Your honor, if you are asking me why I am defying you, it is because I have a low torenance for stupidity." Not my best moment.
He order the sheriff to handcuff me and take me to the Department of Corrections for the next four years. The Sheriff said he would take me away but would not handcuff me because he felt I was correct.
What did I learn? I can make a knife out of just about anything and I avoid Saline County, Missouri. Thanks again for the responses. Jeff
