Company policy violation? Because you refused to run illegal? So, it's company policy to run illegal? :biggrin_25511: I'm thinkin that you missed part of the story there somewhere.....

A company can not fire you for something illegal, if they did and you can prove it, they'd have a law suit and you would win lots $$$. I think getting fired from your previous employer would make it harder to get employed with a future employer, they will call to follow up on your termination.

Happens all the time but the companies will word it otherwise. They want u to run legal but........there's always a so-called hot load or can u cover this? If you refuse, good luck with the consequences!!! When the turd hits the fan, the blame goes on you. CYA is one of the 1st rules a driver should learn. Always has been and always will be the same in trucking. Just take the lump and keep searching. When applying 4 a position, come out straight forward on the last employer. I had a driver in one of my trucks with a big ouch on his dac but he forwarned me and explained his side of the story. 5 yrs later, he is the best driver i have ever had in which he later purchased the truck through me and became one of the best reliable friends I've ever had.

I was terminated from a previous driving job for breaking company policy also.
It was very difficult to find another job but eventually did after figuring out how
to play there game. Here's the thing they say they will check with your previous
employer on what exactly was the company policy you broke but they will rarely
get an answer they will respond with they broke company policy and that's all we
know. Of course they will act like your previous employer will give them all the
details they need but they won't most of the time. The fact is they only know what
tell them as far as the details on the company broken policy that is. My dac report
shows I was terminated for breaking company policy and that's it and that's all they
will get or see also other then what you tell them. Get the point? In another words
find some company you won't ever work for and try to get hired on and make up
something on why you got canned. Tell them something like you took your boy on
a trip and didn't report it and a driver from the company ratted you out or something.
You get the point. Take note on what happens. they wont find crap..

my point was there could be alot worse sounding things out there like they caught you with booze in your truck or something. I mean what would sound worse, I took my kid on a trip with me or they caught me with booze in my truck? get the point? this is not rocket science here bro's.. read it again or something..

Joseph...you are right. Most employment law states that a company can only dispense what was the employees last action (ie, retirement, resignation, termination, and maybe a general reason as to "why") and other minor things about you such as length of employment. Even the release that you are usually forced to sign does not really give them any more authority to obtain past information about you. It is just their way to CYA.

The OP probably has another job by now and is senior driver. But your right it's not rocket science. He said he was fired for not wanting to drive illegal and the company put on his DAC violation of company policy but wont say what, so why would he just not tell them the truth instead of making up a lie that sounds worse than what the truth is. Unauthorized passengers is no big deal in my book (probably yours also), but employers think that is a big no no

Right, I would think getting fired for not wanting to run hot is something that other company's are not going to credit to you being a bad driver (even though we all know that most all company's do this and want driver's who will do it willingly) or anything but like a poster said in a earlier post company's don't fire people for running hot they usually make up some other legit reasons to do it so they don't have to pay unemployment wages. So obviously I wasn't suggesting he should make up a story (lie) worse then what actually happened because I was assuming that the company actually fired him for something else again being that they don't fire people for not wanting to run hot, I mean they do but that's not what there going to tell you if that makes sense.. all the best to you too.
