From the video, you (we), have no idea how long the dude has been there. You never know, he might have just pulled over.
And the last time I was schooled, I believe you have 30 minutes to get your triangles out...could be wrong.

That said, we have no idea how long the guy was on the side of the road.
My point is, that he may have just pulled over. And you really can't make much of a determination based on the video.
