Looking for advice (insurance fault)

    The insurance company agreed that chessie was at fault. It should be noted, the insurance company was the one for cheesie's car. Getting an attorney shows further lack of comprehension of what happened.

    Does anyone think that the car's insurance would have settled that their own driver was at fault if there was any possible way to blame a trucker?

    RM, you and I are on the same page here. No way would the insurance company offer to pay, if they could find any way out of this. I mentioned this on the other thread that cheesie was blabbing on.

    Cheesie sounds like one of those scam artists, let a truck hit him and say the truck was at fault so he can get a huge out of court settlement and it back fired on him, now he is mad and trying to get truck drivers every where on his side so he can win, but i dont think hes gonna stand a chance in hell, when his insurance company said he is at fault, hope he gets it from his insurance company big time, and i mean a big huge loss.

    If I was driving the truck and this happened to me my company would charge me for the accident. We are trained to look for inexperienced drivers like this guy and stop before you do run over anything. This idiot likes to assume alot and really has no idea which makes him the real hazard. Everything he claims is 10 seconds, even the so called wittness. Obviously there's more to the story and we are only hearing from the one that was charged by his insurance company. We have signs on the back of our trailers that say "if you do not see me then I can not see you". So tell me cheesie why did you not give warning? Did you try to make yourself seen or did you assume? There are blind spots on a truck that you are not aware of. If he is turning right then where do you think the mirrors turn to see?

    It would be nice if all drivers drove denfensively but they don't. Even truck drivers drive irresponsible at times but not all of them. Plus if you took a toll you would find out there are better drivers behind the wheel of a truck than smaller vehicles (by the numbers). It just makes sense to drive better because we make more money if we do. But the type of driver that should be banned from the road is the driver that just sits there and does nothing assuming he'll win. The one that thinks he's so precise on the rules of the road that if he thinks he's right then he'll never move. Well cheesie, your day may not get better if the trucking company comes after you to pay for the damages since you were charged. Learn or get off the road before you kill someone.

    No it doesn't, bad drivers come in all different shapes and sizes.

    If you are so pissed off with cars that come up on your right, unknowingly putting them in harms way, I'm here to HELP. If I am at FAULT, then WHY have so many truckers, under Ontario law, been assessed the FAULT? do you GET IT now?

    First off, Ontario is under "no fault" insurance. Both parties Insurance Companies pay for their own. Most often, in this situation, they will take the path of least cost to either of them. Fault, however, falls under legislation and is mandated by the Federal government. There are about 40 accident scenarios which are covered under no fault rules. This being a particularily common one, it IS covered under these rules.

    I do NOT have any issues with the truck driver. This was a simple accident! Inattentiveness(his part) and education(on my part) would have made this preventable.

    My ISSUE is with the insurance comparies who are doing whatever the hell they WANT in Ontario! They DID offer to split the fault 50<50. I said no, as this would net the same results as 100% at fault.

    What I`m having a hard time believing is that I was deemed 100% responsible. A STATIONARY OBJECT.

    You yourself have admitted that your own insurance company has assigned 100% FAULT on you. So do YOU get it now. There's more to this story than what's been told and just by your answers you believe you are 100% correct in what you did. It's really stupid to just sit there and let the truck run over you. But I would have paid big dollars to see you being dragged and possibly screaming along the way.
