I am afraid you cannot escape Uberization for too long.
It is not only Uber but other brokers wanting to access your ELD too. Sooner or later they will ask for it also.
Section 8 is controversial but not entirely unethical or immoral. They simply ask for too much.
As long as they leave section 8 possible to opt out, I would not burn bridges with them, at least not yet. It is business and from time to time they can pay good rates too. When they pay, it is quick and firm. Why forfeit that opportunity of revenue?

I actually don't want to forfeit the opportunity to pull Uber loads. While I am signed up I haven't pulled one yet so I'm wondering how were they tracking before? I will be opting out of section 8 when the time comes.

Maybe They are tracking you by their apps just because you installed them. I have two apps installed. Uber Drive and Uber Freight so perhaps while my location services are on they are still able to track me because the very installation of the apps grants them such thing. Maybe during install I clicked on their end user agreement and consented to their tracking me whether I am signed in or not.
I am not sure but would not be surprised if that's the case. Also Google Maps might do the same and cooperate with Uber Eats.

What is the email address to opt out? Did they reply?

And I would hope that everybody chooses to opt out of that clause.

Coyote was pushing me real hard last year on this section 8 stuff. The guy tried to tell me that after the load is completed they don't have access to the ELD anymore.

I called BigRoad and asked their tech guy if that were true, he just laughed and said the guy from Coyote was blowing smoke.

In reality, BigRoad has access to every place I go. They've started offering their own freight brokering service as well, so it would be real easy for them to leverage my runs.

All my data for only $17.65 a month!

Did you give them the access or did you just do normal updates via email?

I receive emails from JB Hunt almost daily about signing up for Project44 and how I'm missing out on shippers who are participating in the system.
