I am a truck driver. I used an example for you that plainly blew it out of the water.

A company has the right to allow or not allow anyone to use their facilities. There are some states that have laws that state that a restroom is to be available.

How many gas stations have you stopped at and found there was no restroom?

I have been at several docks and NOT ALLOWED in the building. Paperwork is at the cab.

That does not mean what they are doing is correct as far as the law goes. I never met a lawyer working at a manufacturing company. The managers and supervisors are not lawyers.

I just recently proved an entire company wrong! The companies corporate lawyers, Plant managers, supervisors, executives were all wrong and the state or Human Affairs ruled in my favor.

Companies are not perfect. Most companies don't have lawyers in house. They don't have corporate attornies standing by waiting to pounce most companies have no clue! I have worked in many companies and most have a very limited knowledge of law at best.

They just don't know they are breaking the law.

You have not showed that there was any law being broken yet.

    "international plumbing code..." say what?

could someone point to the section of the constitution that guarantees someone a right to use someone else's toilet?

...and they only have enough inspectors to deal with fatalities.

The constitution is not the do all and end all of rights, that's why we have state and local laws. However, the constitution guarantees equal application of such ordinances. Whether a case could be made for this or not is beside the point, as some jerks will still break the law. The driver is in control of the load until it is unloaded.

In my first month of driving I have already seen at least one place like this and the fellow in receiving was a real jerk. I did not have to use the restroom when I got there, but I was reminded of this thread. I think next time I will ask before backing up to the dock and if denied, take the load to the nearest truck stop or rest area, even if it is 40 miles away.

I predict a short trucking career for you. I'd like to hear your explanation to your dispatcher that you left the customer, didn't deliver the load, then drove 40 miles out of route because they wouldn't provide you facilities to pee or poo.

I'd tell 'em what's up, and if they have a problem with it, they can touch their monkey.

Sounds like a case for cause and effect.
I don't reckon I'd be a fan of truckdrivers either, if they went around pissing on peoples's cars.

I'm not saying this is going to be a regular activity for me, but I am not going to let anyone treat me like a caged animal either. Sometimes you just can't wait and if it happens at a place like that it will get taken care of one way or the other and at a place like this it is sure to upset someone, so it might as well be the jerk.

what are you going to do when you're parked in the middle of no where, it's 3AM, there is not a toilet available for 10 square miles, and you have to take a ####? after I drove for about 2 weeks, and had to use my small trash can a few times, I invested in a potpher from the sports authority. $12. it has come in handy more than once. not the most pleasant activity to take a #### in your truck, but it beats soiling yer britches! like the sign said at one of the customers I used to deliver to...."this is NOT a truck stop." maybe you can sue the customer for not letting you blast a load of explosive diarrhea all over their restroom......I look forward to seeing your case settled in the supreme court......the historic landmark case of DsquareD vrs. foodville warehouse - all the man wanted to do was spread his cheeks and squeeze out a mud monkey - and this evil mega corporation denied him his right to use their great ivory tower.
