Can I file against the brokers bond?

    Arrived at shipper a 2 hours early. When it came my time to load I was told the load was accidentally put on another truck. Shipper started to load me with a load going West, that I couldn’t haul. Broker was involved and trying to find out what happened. They told the shipper they couldn’t just load me with any load I needed the one i booked, and to not load the other load on me. Broker offered a tonu /sit time of $300 AND said the carrier that was loaded with my load would be brining it back and I could load at 7am the next morning and still do that load. So a tonu and then the load at the rate we agreed to. I told them no, that I wanted paid for the load since they started loading my truck then took it off. Can I go after the bond?

    If I Understand correctly. You are being paid $300 for tonu and layover. And they are going to load you with the load you booked. Sucks, that you have to wait until morning, but $300 for a layover is not bad

    Bonds are only for non-exempt cartage fees, not for accessorials. Sure you can file, but it will be denied.

    That’s what they offered but I said I wanted paid for the load or I’d go after the bond and sue if needed to get it.

    Yout getting the same load you booked at the same rate, plus $300 for a layover. And you want to get paid for the load they mistakenly loaded on your truck, that you didn't want and never hauled. Its never going to happen, and the bond company will probably laugh at you.

    Technically my truck was loaded, they had put a piece (wrong load)on my truck amd took it off when broker told them they couldn’t load me to just anywhere.

    If they loaded my truck /even tho they took it off I should be able to sue for the load payment right? My time is money.
