Hey y’all. I have been driving solo with a very popular flatbed company for three months now. I have been doing my very best and was even considered a top employee because of bonus points I earned while driving.
This past Monday I was told to deliver to a company in Oklahoma. The weather was icy and many businesses were closed, but no fleet manager contacted me to say stay home. I went and the business I was supposed to deliver to was closed, so I stayed in my truck for the night in 1 degree weather. I called and was told to wait and deliver the next day. I did. I was then given another trip on the portal to go to another state using i-40. While driving on i-40 in Arkansas there was awful roads and as seen on the news tons of trucks were stuck there -even abandoned. As I was driving, there were cars parked so I went off the road and my truck got stuck. I didn’t hit anyone. Nobody hit me.
I knew this would count as an accident, but I didn’t want it to count as “preventable”. I was towed out because my truck was stuck and was told to take the truck back to my company to get fixed (never oh it’s dangerous don’t drive) . I called the safety guy and was told it would be counted as an accident and that it was not preventable. Good news for me. I was in contact with safety again and was then told it would be counted as preventable.
I took the truck back and waited without a heater for the night because they couldn’t get me a hotel or car to go home. Again, freezing temperatures. The next morning they got me a rental and I went home. That was Thursday. Today is Monday and I was waiting for them to tell me when the truck would be fixed, but I was told I was terminated.
They pressure you to drive in these awful conditions and then fire you. I asked the man I spoke to to send me a termination email in writing so I could know exactly why I was fired since he couldn’t really answer me. Clearly, it was because of the accident, but it was not preventable. They had me driving in these dangerous conditions. What really upsets me is that I had worked really hard to earn bonus points last quarter so I could get paid more this quarter and now this.
Can I file a claim against them? Can I at least get a written statement for why I was fired and why the accident was considered preventable? Thanks.

Find a new job, explain what happened, if you don’t feel safe, don’t drive, who cares if they say “We have nothing, get there now!”

This is a bit of a conundrum for drivers with little experience.
Yes you do feel pressure to keep going, you want to make a good impression with your abilities. Part of that is to show good judgement when the going gets tough.
The people in the office have no idea what the road conditions are like. Ultimately it is the driver’s call when to
park it.

File a claim against them for what? You chose to drive in dangerous conditions. Unless you have a message from dispatch, on an app or the QC, that says "you must deliver this load or else..." the responsibility is all yours. If you do have proof of coercion, then the company may be in violation of the whistle blower act of the Surface Transportation Act of 1982..
The days of "Billy big rigging" in dangerous weather are not worth it. You are only risking your life and the life of others, and for what, showing up and the customer is closed. If you parked the truck and sent in a message on your pc why (ice, snow, whatever just happened down south,) they won’t question it.

as for the statement, written or verbal, you are owed that and should get one.
now that said, you ain’t going to like what I tell you.
if you have a cdl, you need to learn who is in charge of that truck, it is you. It isn’t safety, it isn’t the old lady driving the dodge racing down the road ... it is you. As for anyone else too, you have to learn how to be a grown up and say “no”.
actually I will move this a step forward, it should be part of your skills test, to see if people testing for a cdl knows the word “no”.
it isn’t a hard word to learn, it isn’t something that should be used for everything but because you knew the roads were bad, you knew that there exists something called snow and vehicles are stuck, you got to get the idea the word “no” needs to be used.
also, a big pet peeve of mine and a lot of others is this ‘a very popular flatbed company’, who in the heck is that? My company is very popular with me and my drivers but may not be with others, if you worked for them, name them.Bo Hunt, NavigatorWife, Farmerbob1 and 10 others Thank this. -
