Alcohol prohibited from trucks during down time?

    DUI and Your Commercial Driver's License

    If you were off duty in your own vehicle, the normal threshold of .08 BAC (blood-alcohol content) applies. If you were driving a commercial motor vehicle at the time of your traffic stop, DUI is charged at a lower level of .04 BAC.
    If you were driving your own car and it is your first offense of driving under the influence, your personal Pennsylvania driver's license may be suspended for only 30 days. But your CDL license would still be suspended for one year, with no chance of obtaining an Occupational Limited License (OLL).
    A second DUI conviction within 10 years (on duty or off duty) results in a lifetime CDL revocation, ending your truck driving career.

    It didn't read that way to me. No mention of DUI CDL out of a CMV. Maybe I missed something?

    Need more coffeeeee.

    The first is for a private vehicle.

    Tennessee DUI law code 55-10-401 states that it is against the law for any person to drive a motor vehicle in the state of Tennessee while they are under the influence of alcohol or drugs with a blood alcohol concentration level of .08% or greater.

    This is the rule for driving commercial

    A person operating a commercial motor vehicle in the state of Tennessee while under the influence of alcohol, drugs or an intoxicant with a blood alcohol concentration of .04% or greater or failing to submit to a chemical test is in violation of the state's laws regarding CDL's and will be arrested for DUI and your CDL will be revoked for a period of 1-year following a first offense violation. A second CDL DUI offense will result in your CDL being revoked for life.

    I don't see a specific exemption for driving you personal vehicle. It might be an expensive point to argue.

    Out teachers tell us other wise.

    I think I'll err on the side of caution.

    It is a very confusing issue to say the least. I really do not know if the police would know the difference.

    I initially had heard that there would be reduced levels on CDL's at all times. I then found this was not true.

    You are correct, it is not worth finding out the details.

    Thank you for the links roadmedic. I knew this from chatting with a good friend that is also a ND state HP.

    It doesn't matter really because eitherway drinking and vehicals do not mix period. I wish they would lower the limits across the board and start doing alot more enforcment.

    When I lived in Naples Florida they set up check points. Never in the rich neighborhoods! It is a big money grab. The whole ordeal is a $10-15,000 dollar game.

    When I took a defensive driving class in 1974 our deputy sheriff teacher told us "swish you mouth with a beer and you will blow a .10 or more."

    BTW did you know a Certs breath mint will get you a DUI?

    Their active ingredient "Retsin" has alcohol in it.

    Look inthe FMCSR 392.5. In Calif. if you have a CDL you are held to that level.
