Coffee breaks and Logs

    If I am away from my truck having coffee or lunch in a restaurant am I considered off duty? Thanks.

    This is a trick question isn’t it? Ok Monty.... I’ll play! Where’s the camera? It’s in that a/c vent over there isn’t it?

    FTR, I go on duty as soon as I get to my truck and that’s where it stays (if not driving) until I park it and go home at the end of the day.

    Now with it just counting drive time, I'm able to go on duty again and not touch the clock until 12 hours later.

    I could log out several times including when I go to the yard , hop in my pickup, and go to a restaurant for lunch. I don't bother because, well, why bother? 4-5 12 hour days a week is plenty for me. I get paid well enough I don't need to be bumping into my clock every week to be comfortable.

    If you work Monday - Friday like I do, it’s impossible to run out of hours. In my case, I rarely have less than 15-20 hours at the end of the week.

    If you're off duty when you have an accident but you're logged on duty, the company could take a hit.

    How are you going to have at your fault accident if you're not driving? And if you parked where you were not supposed to park causing an accident your company will get hit no matter if you're off duty or on duty. The only way your company will get hit if you decide to sue them...
