FMCSA investigation due to ELD violations? What to expect?

    Hey i got an email saying fmcsa wants to investigate my company. Im a single truck owner operator. They called saying i had multiple eld violations so they want to do an investigation? Anyone ever had it done? Im kinda scared. The cop on the phone said its mainly an educational thing, but im not sure he’s just saying that.

    i know i have several eld violations and my logs are probably pretty bad. Would they shut ur business down?

    How would they know you have ELD violations ?

    you get cited at a roadside inspection ?

    or does your ELD automatically notify them when you have a violation ?

    I don't believe so, I do believe that you must show some sort of repercussions for those actions, i.e. (training), something to show you slapped the back of your hand for each

    For the eld violations i already got put “oos” and did the 10 hour or 34 hour shutdown before they let me drive again.

    he said because i had multiple violations they want to investigate to see if i was safely operating it.

    Just guessing but they probably run an audit of a company's logs that they're required to keep a record of then discover the violations.

    Yeah i know for sure because i totally go over on my eld. Usually if im near home and my hours run out i’ll just keep going. So its a bit of a mess. He did mention id they spot a lot of things, they will show me how to correct it but i will have to do my due diligence. I just dont want some big fine or be put out of business. Maybe im over worried.

    Yeah thats what im worried bout, i have a lot of days where if im just an hour away from home n run out of drive hours, i’ll just keep driving home.

    I think usually they will put you on some kind of probationary period and give you a chance to do right. If you keep screwing up them it could be bad news.

    If you are worried about the consequences of breaking the law, you should not have been breaking the law.
    Sorry, but I have zero sympathy for law breakers.
