Has anyone's career been jeopardized because of a previous employer?

    How do you deal with a disgruntled former employer that not only wont put in a good word for you, but actually try to sabotage your chances of getting hired for a new company when they do their work history verification and what not.

    Not my case, but I'm want to be prepared lol

    Might be able to find a lawyer willing to fire off a cease and desist type letter. Ruffle some feathers, make em think twice.

    Do you have your pay stubs or income tax returns?
    Some companies will accept those when a company refuses to cooperate with job verification.

    Always keep your pay stubs and trip reports and there should be a way to save your ELD data

    some companies refuse to acknowledge you worked there because they are mad that you left, so be prepared to prove you worked there. How long you worked there. How many miles you drive etc .

    also you should keep your pay stubs to prove the company withheld the taxes ,
    A lot of companies , when they get in trouble financially , will keep taking taxes out of your pay but won’t send it to the IRS, and will stop paying your health insurance etc .

    The FMCSA has a procedure in place for this. This can be found in 391.23 (c)(3).
    (3) Prospective employers should report failures of previous employers to respond to an investigation to the FMCSA and use the complaint procedures specified at §386.12 of this subchapter. Keep a copy of the reports in the driver investigation history file as part of documenting a good faith effort to obtain the required information.

    I have had voice conversations with FMCSA personnel in two of their service centers about this topic. Baltimore and Atlanta. The last one was Baltimore about 18 or so months ago. After my call, it took about 2 days, but the carrier did finally respond with the legally required information. Ever heard the phrase "stink on (redacted)???? This is how the FMCSA reacts to carrier violations of 391.

    @Ridgeline and @REO6205 as well as @brian991219 should be in a position to know about how tight the FMCSA is on 391.

    I had SUCCESSFULLY challenged a "Previous Employment Information Report" at HireRight (DAC) out of Oklahoma.
    They contacted the Company in Question and The Company Rewrote their Information.

    I was not aware of the F.M.C.S.A. route.

    Most important to CYA on the taxes. That letter you get every ten years, or so, from the Social Security Administration showing your earnings over the years.

    I got mine and it showed that year only 50% of my earnings. Working for the US arm of a Canadian carrier and spoke with my boss to find out they forgot to report 1/2 of the year to the SSA. My next letter show I made 1.5 times as much the next year as they were forced to make it up. That was just an accounting error and not malicious.

    Another carrier with held our 401K but didn't deposit the money; almost ended up wearing matching federal chrome bracelets when a former employee's widow tried to cash out his 401K monies. Was forced to pay us all out and close the account down barely avoiding severe punishment.

    Keep your records, you never know when you need to prove something.
