He knew that, the problem is he knew it and should not be driving at all, the load isn’t as important as the cdl.

Only the first firing stings a little. They're easier to take after you get the first one out of the way.

I agree. It would have done him better to seek advice on here first before making that call, before telling a company that you're going to break the law.......

    that's the problem.....NOT thinking.

i see it as road wear on his brain.

    fed up with nearly everything.

after he called and said he was going to do it and go home, the person he spoke to could have took that to mean, he's quitting.

if the call was recorded, they got proof of his intentions to break any rules/laws and work illegally.

had there been an accident, that's all the proof they would have needed to nail his coffin shut.

this can be used against him too, for a job reference.

I can tell you first hand that when a fatality is involved, the last 30 days of driver logs are demanded by the State Police. Then it's just a matter of discovery for the grieving family's attorney to demand it too.

Even when 4 eyewitnesses signed affidavits at the scene that the "victim" drove into stopped construction zone traffic at 65 mph and never touched the brakes.

You can be the best supertrucker that ever was, and that kind of unpreventable is where that seemingly minor HOS indiscretion turns into a real big, company-ending deal.

I had no idea they demanded logs back that far. I thought it was just 8 days back until it cleared the ELD screen and then it’s out of the question. Makes more sense then why my company took it serious. Even when most people’s ‘in reality’ opinion agrees 15 minutes past a 14 to get home is basically meaningless, insurance and attorney’s don’t play around. Lesson learned for me going forward. Finally starting to understand why the old timers preach about missing running on paper.
