    he did that, it went out again, they said it was en electrical issue and couldn’t get it fixed anytime soon and to only drive during the day, even though that wasn’t possible with the loads and the waiting time for unloading/loading.

    But he still chose to drive with faulty equipment. He should have told dispatch. This load is going to be late. Due to an electrical issue. Since they were not going to fix. He's the captain of the truck. Sounds like your husband needs to go to a different company.

    Sounds like they may have looked at the time stamps on his bills and bounced them against his log? What did he do, log off duty for loading/unloading?

    Otherwise, I’m confused how he screwed up an e-log bad enough to get caught.

    For future reference, he should follow these two simple guidelines.

    1. Do not drive a CMV with a SAFETY defect (tires, brakes, lights, leaks).

    2. Log as he goes.

    Remember this is being filtered through the wife. My 100% guess is he was driving after his 14/70 on PC to try and hide the fact he broke the 14/70 and got caught.

    Intentionally falsifying logs is a pretty serious charge original poster. I’m pretty sure it can even be deemed criminal. I think it’s a misdemeanor. If they can prove you are intentionally falsifying the logs. They’ll even send under cover drivers to work for companies they suspect are cheating on logs. Don’t take it lightly and I suggest bringing in a good lawyer

    Work some place else! A reputable co will not tell you to just drive it during daylight hours. Besides when the DOT does an inspection during daylight, guess what?

    Big difference between failure to keep current log. And falsifying log. I second the Lawyer. Best defense is an honest mistake. If it’s in fact a falsifying log ticket. It’s an expensive one. I got one once, went to Court, got it reduced to not current log. That’s really all they had. $ 50 fine vs. $300 fine. Headlight on CSA won’t hurt much.I think it’s a revolving 36 mos. on CSA record. Falsifying log probably will hurt CSA. Fight the ticket. Might cost $600 or more, do what it takes. As of now he’s only been accused not found guilty.

    I had a nice dinner tonight with a friend who is a retired Virginia enforcement officer. He also brought his wife and another couple and I later learned this man works in Richmond with the VSP MCSAP dept. Afterward I thought about this thread and actually used my iPad and showed this man the actual question. This is what he said. This is covered by 395.8 (e)(1). No driver or motor carrier may make a false report in connection with a duty status. He went on to say that ALL enforcement officers in Virginia are taught this "report" starts when they either look at a logbook or an ELD. He then laughed a little and said today most officers don't get too excited about 395.8 (e)(1) because they rarely see paper logs anymore. As you stated there is a HUGE difference between a log not current and a false log. The retired officer added in his mind the difference between a violation noted on the inspection and a possible citation as 395.8 (e)(1) and the lesser serious 395.8 (c), was the driver's attitude during the stop and how egregious the violation was.

    I remember going into the flying J in Ehrenburg Az years before Pilot bought them out. It was early in the morning and I walked in and sit down to order. I was humming a song I long ago forgot the title. The server came over to me, poured a cup of coffee, and gave me a menu. I noticed a few minutes later a slice of apple pie. I told her I did not order pie, but that it sure looked good. She said, no, it was just her way of saying thank you! She just needed to see a smile and a happy face that morning. Just never know how far a good attitude will carry you in this life!
