If you file small claims be sure and let us know how it turns out. A lot of drivers in the same predicament could use that if it works.

    Welcome to trucking
Most peoples answer to why they failed at trucking is ... Things were working ok but then the truck kept breaking down.

Your young my guess. Isx had a series that ate fuel pumps sending ceramic through oil system. Couldn't keep cams in them, and blew head gasket. Some at 100k, some at 500k, and some went a million. Certain models were garbage compaired to N14, and BC.

Oh and loved to send a rod through the block. I like Cummings, but this is the facts.

Just read, you will see I'm right.

If I were in the OP's shoes, i'd make sure I'd collect whatever money the Florida shop is going to send. Then assess and see if it is worth the hassle of going through legal proceedings to collect the indirect damages.

Legally, the fact the shop's insurance company doesn't cover something has no bearing on whether the shop is liable for it, or not. That's a contract between them and the insurance company. But it probably would be worth a couple of hundred bucks to an attorney to see what indirect costs the law allows in a legal claim. Even if you file in small claims. And be aware that small claims decisions can be appealed, at which point you could be on the hook for significant legal expenses should you lose on appeal.

Here is going to be your problem, proving that it wasn't put together right.

The shop you are having the work done at has to be able to document everything as they pull it apart, and if they don't, then there is a question that can be raised about the 2000 miles that it was driven before any issue happened showing that it is not the first shops fault.

It is sometimes good to get Cummins involved to have a regional service manager help document the issue for you. This gives more credibility to your case, if you may want to sue for damages and losses.

Yes, it's being documented and sent over to the shop that did the previous work They're aware they messed up. And dealer confirmed the previous shop was at fault. They're paying out of pocket for all the damage.

We aren't going to fail. The previous shop is at fault. They're fixing it.

Their insurance covers this, just not the rental we asked for to off load the 2 loads we have. For whatever reason, they're paying out of pocket for the repairs. It will get fixed, and I'll invoice them for the extra expenses. If they refuse, i'll so what I have to to show them I don't tolerate this. Trucks will break. But when its because they cant put things together correctly, it's their fault. Not ours.

This was due to a repair shop who did our DOT inspection and repairs. They didn't torque the 3 bolts inside the gear housing. Not the motors fault. And no IM not young LOL I'm 41 We also know what kind of motor we have, potential issues etc. I don't need to read on it. This post wasn't out of ignorance. Its about a shop who didn't do the repair correctly. Its being fixed by the dealer.
