Your young my guess. Isx had a series that ate fuel pumps sending ceramic through oil system. Couldn't keep cams in them, and blew head gasket. Some at 100k, some at 500k, and some went a million. Certain models were garbage compaired to N14, and BC.

Oh and loved to send a rod through the block. I like Cummings, but this is the facts.

If I were in the OP's shoes, i'd make sure I'd collect whatever money the Florida shop is going to send. Then assess and see if it is worth the hassle of going through legal proceedings to collect the indirect damages.

Legally, the fact the shop's insurance company doesn't cover something has no bearing on whether the shop is liable for it, or not. That's a contract between them and the insurance company. But it probably would be worth a couple of hundred bucks to an attorney to see what indirect costs the law allows in a legal claim. Even if you file in small claims. And be aware that small claims decisions can be appealed, at which point you could be on the hook for significant legal expenses should you lose on appeal.

 

Here is going to be your problem, proving that it wasn't put together right.

The shop you are having the work done at has to be able to document everything as they pull it apart, and if they don't, then there is a question that can be raised about the 2000 miles that it was driven before any issue happened showing that it is not the first shops fault.

It is sometimes good to get Cummins involved to have a regional service manager help document the issue for you. This gives more credibility to your case, if you may want to sue for damages and losses.
