OT after 50 Hrs. Why Don't Old Dominion Drivers Complain?

Overtime is overrated, I used to work for a company that paid $30/hr straight time but we got a bonus of $20 for every load we did. 4 loads a shift meant I got paid 4 hours of overtime from day one.

 

Maybe the base pay is high enough that they don’t care? Then there’s also the guys who are convinced that companies who pay OT after 40 will make sure you never get more than 40, which is obviously not true.

Personally, I don’t get it either. If I ever go back to an hourly job, OT after 8/40 would be one of the first things I look for. If the job is just straight time, the base pay rate would have to be ridiculously high for me to not care about work cutting into my free time.

 

Trucking companies are exempt from paying overtime.
Old Dominion drivers are lucky; at least the company pays it after 50 hours, when not required to.

A company may have to pay overtime to a truck driver if they have worked more than 40 hours in a work week, however there are certain exemptions. There is an act call the Motor Carrier Act (Section 13 (b) (1) of the FLSA) which exempts drivers who regularly travel across state lines to make deliveries from overtime pay.

It’s a loophole that should be illegal IMO, if punching a clock in and out at the same Location everyday. Overnite used to do that. Not only did the Drivers make 2/3 of what Teamsters made. It was all straight time. No OT at all. Drivers were classified as Road Drivers. One Load home from orientation in Va. Lol.

 

It’d be nice if we got mileage * 1.5 after we hit the 40 hour mark which is typically about 4 days into the work week.


Making $108K a year isnt bad but 52 hr work weeks to do diminish its value.

 

It’s sure not worth it when every minute is scrutinized either. I’d rather work somewhere that’s not so anal. I couldn’t do city work at UPS, I wouldn’t, regardless of the pay. I prefer Road Work for that reason. Much rather work at my own pace, with People that are reasonable to work for. Definitely not all about the money, especially when you look at a whole lifetime of work.

 

If the OD driver makes $33.00 and o.t. after 50 and you make $30 and o.t. after 40 you will make the same for a 50hr work week. If you're not getting o.t. then the OD driver makes more than you do for a 40hr work week. I'd rather make more in my 40 and not hope for o.t.

 

CPM and lack of OT is one of many reasons new drivers are not staying.
With mandatory ELD in trucks there's no reason a driver couldn't be paid for all of their time just like the office worker is.
