Waiting weeks for truck repair

    Ok...so you saying that people don't want to work is not quite accurate. The unemployment rate is at 4.6 percent. I think you should think of it this way: perhaps people are finding other avenues of work that either pay better or are better for his/her situation. Many people are taking work from home jobs. If you can make the same money without putting on pants, why wouldn't you take it? Lol. Some folks are going that route to avoid child care or commuting costs. Both of which can be costly. In our society, if we can't get prompt full service or answers then we blame everyone and say, "they don't want to work." I think thats unfair to say.

    I went by my one of my favorite truck stops, and realized that the restaurant was closed. They had great food. Why did they close?

    “they don’t want to work.”

    The big companies get bailed out. The mom and pops get the same stimulus check that everyone else gets.

    “Sorry about your family business, here’s $600! Be appreciative!”

    No they don't care for real. I still have the load. They have waited the entire week and the customer and broker are angry.
    They claim they can't find a driver to get this load.
    So I don't want to leave a trailer just loaded and whatever. They are now discussing flying me back to get another truck , which means I will have to drive back here bobtail to pick this trailer up. Which means at least one more week late. I think they are lying to me. They get $2000 deposit from me if I leave the truck and of course that DAC report. I can't let this ruin my life.

    No. Do not abandon the truck/load. They will zap you for that. I hope you are getting this documented. Emails if possible. Be sure to keep a detailed notebook with date time and who said what. Somehow you've got to get out from under this.

    Are you actually with the truck or are you off duty and relieved from the responsibility of sitting on the load?

    this is a very important question to have an answer.

    I am off duty. The truck is out of service. I don't have the keys, the mechanic does. I'm logged out of the eld. But the trailer is disconnected and on a different lot.
    I've been trying to get a lawyer to ask if I can get away from this company, but when I talk to lawyers , they always end up being collision or violation lawyers. No one will give me advice on what my rights are in this circumstance. Asking here is sending out feelers for a solution. I will not leave the trailer if I don't have a solid legal statute to reference.
    So I don't have the keys, and now I think my company is thinking of sending me on a plane to the yard to fetch another truck and come back to deliver this load. But I am fed up and I just want to leave. This is such a convoluted mess.

    Yep. I have text and I take notes of what is said on the phone , time date, etc. I do screen shots of the texts and that is backed up in the cloud on my phone server and in my Google account.

    Your a contractor, not an employee. There is no work for you. Move into a better company and paid on a w2. This whole thing is your fault to begin with. Now it’s time to fix your mistake and move on.

    People are way too scared of DAC. By far, more employers don't use it than does. Even if you get a false report simply dispute it. The company has to provide proof of their side. Yes they can lie, but that's a court case you will win.
    In the meantime simply work at a company that doesn't use dac. You'll likely be happier anyway.
