Person loading damaged the load and is filing on my insurance?

    I booked a load off central dispatch to haul a boat on its trailer. The owner was going to back the boat onto my trailer and had a forklift to unload.

    The owner is backing the boat onto my trailer, but he hadn’t locked the tongue to his trailer ball hitch. Once the boat got to a certain angle on my trailer ramps, it disconnected and rolled back down into the rear of his SUV. A police report was made and he filed a claim under my insurance trying to get my insurance to pay for repairs…

    Am I screwed on this? Is there any reaction I have to defer his claim and keep it off my record?

    I took pictures and the police report shows me as a witness. He owned up to it in the police report as well. I think he had some mental incapacity and honestly thought maybe someone else’s insurance would pay for it

    If he admitted to it then i wouldnt worry about it. Just stay in touch with your insurance company and maintain the narrative that it is his fault.

    I’m not worried that I will somehow be held at fault, I’m mad that I’m the future when getting a renewal I’m going to have a claim on my record because this guy didn’t know what he was doing to get his SUV fixed

    Why did you give him your insurance information ?? It’s not your problem till HE has it completely loaded.

    I think the broker or police gave him my insurance info

    It's the insurance companies decision to pay or not
    They will chose the cheapest option. Court cost and lawyers to fight the claim or just pay it.

    Any payout is calculated in your run loss for 3 years. I was told by my agent recently.

    No matter what trailer anyone pulls you need to take pics
    I have actually pulled my phone out either before they load or if doing some Monday morning tricks unloading me
    If it looks sketchy I take pics
    I have actually made receivers sign my BOL if I know they are going to unload me in a not so correct way, I simply say you need to sign my BOL for we start to do tricks
    Haven’t had any not sign
