So confused!

    So I’ve had my CDL for 7 yrs now. I had my HAZMAT for the first 3 yrs but let it go (Washington state). Now I live in Oregon, tried to get my HAZMAT endorsement the other day and they informed me abt the new requirement of re-training & would not let me take the test! WTF!!

    But according to this she was wrong. Am I reading this correctly?

    “You are not required to complete applicable ELDT if:
    • You have proof that you have held a Class A or B CDL, passenger or school bus endorsement, or hazardous material endorsement at any time in the past.”
    New requirement for entry-level commercial drivers takes effect Feb. 7, 2022

    Just take the test again.
    It will be much easier then fight with DMV office.
    It's not that hard, and free anyway

    I would gather all the documentation that supports your argument and speak to a supervisor. I read your link and it seems as long as you can prove you had it in the past you should be able to add it again.

    thing is he had it in Washington and not Oregon. So that can be the reason.

    Common sense would say since it is “federal requirements “ and the idea behind a CDL is it’s supposed to uniform rules from state to state it shouldn’t matter but we all know common sense and government in the same sentence is an oxymoron….

    One of the rules is “you can’t argue with stupid,” and we all know majority of DMV employees could care less and aren't the brightest. So you are stuck with their demands.

    only hope for the Op is to find someone smart enough and willing to look up the laws regarding the issue.

    Get a MVR from Washington state showing you had the endorsement earlier. I'm not sure, could it be the Oregon person couldn't pull up the Washington records. Or didn't want to take the time.
    It may be Oregon or that person considers your CDL issued in Oregon as NEW.

    I'd run it up the chain as others have suggested. If it's still a problem it's up to you to either take the class or, "move" to WA (rooms can be rented in Vancouver for <$400/mo.) and get a WA CDL with HM. You can either, "move" back to Oregon and then swap for an OR CDL with HM - kind of hard for them to argue that you don't have HM when it's on your WA CDL or, "stay" in WA and pay their income taxes instead ($0).

    I'm not a lawyer but it looks to me like your current CDL should exempt you from having to take ELDT.

    If the lady can't understand that then I guess you have to ask for her supervisor.
