Broker/Shipper left me stranded for over 24hrs on busy highway.

The Disabled truck was there for too long, true but it was on the shoulder, not on the travel lane.
The garbage truck driver went off the road, that's what I consider the main cause of the accident. I will never agree that the garbage truck driver w as without fault there. They both were, and neither ought to seek any damages from each other.
Had he veered off the road and hit a viaduct pillar, if such were there, would you blame the architect who placed it there too?

 

@M915MOVER You made a very bad decision on pulling over on the side of the highway for as long as you did and now made another terrible decision by posting on here.Get an attorney right away and a very good one at that.Second write the forum moderators to delete this thread and if they don’t get your attorney to contact the owners of this forum.Do not write anything else regarding your situation on here or anywhere else including social media.Don’t even talk to friends and family about it.

 

Well, maybe it wasn't load coming loose as a reason to pull over.(after seeing the pictures)

 

If the load was coming loose throw a couple more chains and straps on it and get it off the shoulder maybe it wouldnt make it to the next truck stop but it wouldve made it to an exit ramp

 

Holy #### after seeing the pics those 2 garbage truck guys are lucky to be alive. No critical thinking was used at all

 

Idk they might not survive their injuries at this point still

 

Often times chassis (if he was properly contracted as a port driver) do have service contracts and in that case he would need to be sitting on the side of the road and wait for service, otherwise they could hold him liable, for example if the thing tips over or falls off.

In case of those contracts, anything arranged on his own would be his cost.

That being said, and with benefit of hindsight, he would’ve been better to unhook for his safety, call cops to report it so they could tow it and they would bill the towing to the chassis owner. There would also be one hell of a fight to unwind this.

I think he had far less options than some here assume.

Unless they were all just trying to pass the buck, nobody wanted to be the one paying for towing because he wasn’t contracted, so he sat while nothing was actually happening on the matter. And this could’ve been the case if it was just a power only run, like it seems it was. He said he had no chassis interchange.

In any case, he should’ve been informed that there was no towing coming, I think he should be suing, he might be sued too. Maybe everyone involved will.

 

There is no in hindsight. He simply should not have been there for several reasons. Not the least of which is his falsified logs.
The lawyers for the garbage company and/or the guys in the garbage truck are going to eat him alive if for no other reason than that.

He simply should not have admitted to going off duty (shutting down for the night) when he legally had to stay on duty.

Yes the driver of the garbage truck will be held partially at fault, but with false logs in the mix I doubt it will be much of a percentage.
