You can try to work out a payment plan with shipper. If not it becomes legal matter and the best thing to do in a legal matter is stall.
I don't understand why driver set wrong temp. Bills always have temp on them and you should have confirmed with driver.
If driver is 1099 you could try to put it on them.

Have you looked at the average truck driver lately? Or human being, for that matter?

Remember, half of hem are dumber than average.

This thread is a good example of what happens when one driver can make a big enough mistake to ruin an entire company.
I'm not saying that this is the case with the OP but when you hire marginally qualified drivers, drivers whose grasp of the English language is questionable, pay them peanuts, run them like a sled dog, and then blame them for everything that goes wrong you've started down a slippery slope. I hope the OP makes out alright on this but he needs to do some serious thinking about the way he does business.
A company gets the kind of drivers it wants. It also gets the kind of drivers it deserves.

Some insurance companies you can add insurance for driver error on temperature. Not all insurance companies offer it however. If you don't have it depending if the product is still good the broker may be able to find a buyer at a discounted rate and you would pay the difference. Otherwise you are responsible, and you will most likely be sued.

If it's branded product it may not be able to be salvaged. Quite a few manufacturer's will not allow it.

Does anyone know anyone who's gone though this and can help me, I'm a small company. I'm so stressed about this situation, I can't afford to have my corporation sued. What happens if they take me to court can they put a lien on my equipment and what does that mean?
