Question about returning plates to lease carrier.

    Got my IRP plates through the carrier I am leased on with, I paid for them in full.

    I signed nothing stating that I would give the plates back to them if I terminated my lease

    Anyone know if I am legally obligated to return the plates? Or what type of attorney I would talk to about this?

    What does registration say?

    Is it in your name or in the carrier's name?

    If it is in your name, they are yours.

    Also look at your contract, you don't have to sign anything, the contract may cover it.

    I would never ever have a carrier buy the plates, I always pay for them that way if there are issues with he carrier, I don't have to worry about moving the truck to another carrier.

    My lease agreement doesn't say anything about the plates. On the registration, it says:

    Registrant / Operator Name And Address

    (Carrier info)

    Owner/Lessor Name And Address (if applicable)

    They are the carriers plate.

    If given by the carrier. They are most likely theirs

    Most will give you some $ back if you leave like one carrier I was on with would prorate them and only refund you once they were able to assign them to another owner op so if they were $2400 they would give back $200 per month of what was left after the new guy took them

    Place I am with now is monthly so if I leave it just stops
    Either way. That’s the main reason I run my own. You don’t save anything and there’s no hassle at the end

    And you eat the time they sit waiting to be reassigned. Most carriers are good at this but some will drag on 'waiting' to reassign

    If there's nothing in the contract then technically thered no penalties. However, they do belong to the Carrier and tjey have all the legal grounds to come after you for them and any issues that surround them. Why do you not want to return them?

    It can't be transfer from one DOT number to another. So in others words they have authority over that plate regardless of where the funds to pay for it cam from.
