Already have a lot of large shippers that check TRU before loading. And they have been fined for loading non-compliant. You can check and see all the fines through CARB.

What the cert will do this year is stop the CA based, or any carrier that has a nexus there, that had a compliant truck and deleted it.

I’ve ran into a couple brokers that require some form of carb compliance, some ask for a cab card for age if the truck. It’s rare but has happened.

The carrier I haul loads for requires a copy of your complaint CARB certificate. They’re aware of the massive fines CARB will issue to a company loading trucks that are non Commiefornia compliant. Incase one doesn’t know, if your caught by a CARB nazi patrol, they will go back and look what company loaded a non compliant truck and chase them down with a fine.

I heard a story about a guy who got nailed out there in a 379 w/ 3406B. They initially asked him if they could inspect his truck and he allowed them. Since CARB does NOT have law enforcement authority, what can they do if you say "no, you aint inspecting my truck unless its a safety inspection" to which they arnt even gonna be CVSA certified to do that...

What authority/power does CARB have to fine the broker? What happens if the broker takes the fine and deposits it in the trash can?

It won’t be the broker it will be the actual shipper. Sort of like how in Kansas the state can go to grain elevators and write them overweight tickets for trucks coming in and going out heavy.

Very similar to what happened to my old company I worked for. We got caught up in a bunch of taxes that a company we sold stuff to owed. It always go back to someone.

They have the same authority as to pull you over, None. Broker can do as they please, however, if CARB decides to do an audit on the shipper/broker cuz a non compliant truck got busted, that’s a different story, hence, CARB doesn’t have enough man power to wipe there own waste anyway’s.

This CARB thing does not resonate well, not only because it exemplifies a typical governmental indolency with little sense of reality but also with the recent healthy diet tendencies where the emphasis is on not eating carbs.
