I started with this company on April 11, 2022. The contract agreement is effective on that date (April 11, 2022). As of April 11, 2023 my year will be up. The company claims that I still need the 120,000 miles to fulfill this contract.
Heres how the contract reads "Provided that Driver Trainee obtains his/her CDL and completes 120,000 miles in operation of a Commercial Motor Vehicle for the Company, or, is employed by the Company for at least one year thereafter, whichever is longer, Driver Trainee will not be required to pay the Five Thousand Dollars ($5,000.00) cost of the Program."
My question is, when you read this, how would you interpret which is longer?
Any lawyers on here?

The only FMCSA reg for part 399 is for access/steps.
If what the OP cut/paste on the contract wording is accurate. The OP can leave at the 1 year anniversary date.
But I would spend 200-300 bucks to have an attorney confirm. -
The way its written "or" doesnt mean "or", it means BOTH a year AND 120K miles

Not really a forum that Lawyers hang out on..
If I was a lawyer I’d probably ask you how many miles have you logged with them to see where we are at.
So, how many miles?Sirscrapntruckalot, Siinman, tscottme and 2 others Thank this.
